Abstract

Default of sale and purchase of land with down payment occurs when one of the parties, both the seller and the buyer, does not carry out the agreement that has been agreed upon by both parties. The case of default on the sale and purchase of land with down payment is based on the lawsuit in the Supreme Court decision Number 67 K/Pdt/2018. The Plaintiff filed a lawsuit to the South Jakarta District Court because he felt that the Defendant's act of selling the house to another party by unilaterally canceling the agreement between the Plaintiff and the Defendant was an act of default. Identification of the problem is whether the down payment system is known in the sale and purchase of land and the legal consequences for those who default on the sale and purchase of land with down payment in the decision No: 151/PDT/2017/PT.DKI Jo. No: 230/Pdt.G/2016/PN.Jkt.Sel. The theory used is the theory of agreement and the theory of legal protection. The research method used is the normative juridical method, the research specifications used are the statutory approach and the case approach, the data source is secondary data, the data collection technique is in the form of library research, and data analysis is in the form of qualitative analysis. The results of this study state that the provision of down payments is legally justified which can be seen in Article 1339 of the Civil Code in conjunction with Article 1347 of the Civil Code that the agreement is not only binding on anything that is expressly regulated, but also things that are customary and common. followed, namely habits that develop in people's lives, namely in accordance with the customs of each applicable customary law. This down payment creates an attachment between the two parties and the agreement only in customary law does not create an attachment. In the land sale and purchase agreement, the down payment system is known and applies in land sale and purchase transactions. However, the down payment is not a legal requirement for a land sale and purchase agreement and the legal consequences for the down payment provider if it does not keep the agreement, then the down payment is considered lost, while the legal consequence for the down payment recipient who does not keep the agreement is the obligation to return the down payment along with the costs that have been incurred. to the buyer. Additional Information: Wanprestasi jual beli tanah dengan panjar terjadi apabila salah satu pihak baik penjual maupun pembeli tidak melaksanakan perjanjian yang telah disepakati oleh kedua belah pihak. Adapun kasus wanprestasi jual beli tanah dengan panjar berdasarkan gugatan dalam putusan MA Nomor 67 K/Pdt/2018. Penggugat mengajukan gugatan ke Pengadilan Negeri Jakarta Selatan karena merasa tindakan Tergugat yang menjual rumah kepada pihak lain dengan membatalkan secara sepihak perjanjian antara Penggugat dan Tergugat adalah suatu tindakan wanprestasi. Identifikasi masalah yaitu apakah sistem panjar dikenal dalam jual beli tanah? Yang kedua apa akibat hukum bagi pihak yang melakukan wanprestasi jual beli tanah dengan panjar dalam putusan No: 151/PDT/2017/PT.DKI Jo. No: 230/Pdt.G/2016/PN.Jkt.Sel? Teori yang digunakan adalah teori perjanjian dan teori perlindungan hukum. Metode penelitian yang digunakan adalah metode yuridis normatif, Spesifikasi penelitian yang digunakan adalah pendekatan perundang-undangan dan pendekatan kasus, sumber data berupa data sekunder, Teknik pengumpulan data berupa studi kepustakaan, analisis data berupa analisis kualitatif. Hasil penelitian ini menyatakan bahwa Untuk pemberian uang panjar dibenarkan secara hukum yang mana dapat di lihat dalam Pasal 1339 KUHPerdata jo Pasal 1347 KUHPerdata bahwa perjanjian tidak hanya mengikat untuk apa saja yang secara tegas di atur, akan tetapi juga hal-hal yang dalam kebiasaan dan lazim diikuti yaitu kebiasaan yang berkembang dalam kehidupan masyarakat, yaitu sesuai dengan kebiasaan dari masing-masing hukum adat yang berlaku. Pemberian panjar ini menimbulkan keterikatan antara kedua belah pihak dan kesepakatan saja dalam Hukum Adat tidak menimbulkan keterikatan. Di dalam perjanjian jual beli tanah, sistem panjar dikenal dan berlaku dalam transaksi jual beli tanah. Tetapi panjar bukan merupakan sebagai syarat sahnya suatu perjanjian jual beli tanah dan Akibat hukum bagi pemberi panjar apabila tidak menepati kesepakatan, maka panjar tersebut dianggap hilang, sedangkan akibat hukumnya bagi penerima panjar yang tidak menepati kesepakatannya yaitu berkewajiban untuk mengembalikan panjar tersebut beserta biaya yang telah dikeluarkan kepada pembeli.
