Abstract
PT. Anekatama Makmur Abadi is a multi-brand Distributor of Electric Motors, Gearboxes, Pumps, Spare Parts and Accessories that serves industrial and commercial needs throughout Indonesia which terminated Lucius Puji Yuwono Nugroho on May 30, 2020. Termination of employment is the most feared by workers. Because workers will lose their income to meet their own needs or even to support their families. Based on this background, the researchers discussed the reasons for PT. Anekatama Makmur Abadi against Lucius Puji Yuwono Nugroho reviewed through Law no. 13 of 2003 concerning Manpower and Law no. 2 of 2004 concerning the Settlement of Industrial Relations Disputes, is it legal? Was the judge's consideration in deciding the case No. 200/Pdt.Sus-PHI/2020/PN.Bdg correct according to the applicable legal provisions? The framework used in this research is the theory of legal protection and the theory of employment relations. The research method used in answering the research problem is carried out by normative juridical methods with qualitative descriptive data analysis sourced from secondary data and primary data. PT. Anekatama Makmur Abadi Terminated Employment on the grounds of the Covid-19 pandemic, because the government imposed Large-Scale Social Restrictions (PSBB) so temporarily PT. Anekatama Makmur Abadi was closed, this had a huge impact on the activities of PT. Anekatama Makmur Abadi because of the obstacles and the entry of operational costs was hampered. The judge's consideration in the District Court Decision Number 200/Pdt.Sus-PHI/2020/PN.Bdg in the case of Termination of Work carried out by PT. Anekatama Makmur Abadi against Lucius Puji Yuwono Nugroho is in accordance with the applicable legal provisions. Because, PT. Anekatama Makmur Abadi in carrying out the Termination of Employment for Lucius Puji Yuwono Nugroho without any stipulation issued by the Industrial Relations Dispute Settlement Agency

Pemutusan Hubungan Kerja merupakan hal yang paling ditakuti oleh para tenaga kerja. Karena tenaga kerja akan kehilangan penghasilan untuk memenuhi kebutuhan sendiri atau bahkan untuk menghidupi keluarganya. Berdasarkan latar belakang tersebut peneliti membahas tentang Apakah alasan PT. Anekatama Makmur Abadi terhadap Lucius Puji Yuwono Nugroho ditinjau melalui Undang-undang no. 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-undang no. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial telah tepat menurut hukum? Apakah pertimbangan hakim dalam memutus perkara No.200/Pdt.Sus-PHI/2020/PN.Bdg telah tepat menurut ketentuan hukum yang berlaku? Kerangka pemikiran yang digunakan dalam penelitian ini ialah teori perlindungan hukum dan teori hubungan kerja. Metode penelitian yang digunakan dalam menjawab permasalah penelitian dilakukan dengan metode yuridis normatif dengan analisis data deskriptif kualitatif yang bersumber dari data sekunder dan data primer. PT. Anekatama Makmur Abadi melakukan Pemutusan Hubungan Kerja dengan alasan pandemi Covid-19, sebab pemerintah memberlakukan Pembatasan Sosial Berskala Besar (PSBB) maka untuk sementara waktu PT. Anekatama Makmur Abadi tutup, hal tersebut sangat berdampak bagi kegiatan PT. Anekatama Makmur Abadi karena terjadi penghambatan dan pemasukan biaya operasional pun menjadi terhambat. Pertimbangan hakim dalam Putusan Pengadilan Negeri Nomor 200/Pdt.Sus-PHI/2020/PN.Bdg dalam perkara Pemutusan Hubungan kerja yang dilakukan oleh PT. Anekatama Makmur Abadi terhadap Lucius Puji Yuwono Nugroho sudah sesuai dengan ketentuan hukum yang berlaku. Karena, PT. Anekatama Makmur Abadi dalam melakukan Pemutusan Hubungan Kerja terhadap Lucius Puji Yuwono Nugroho tanpa adanya penetapan yang dikeluarkan oleh Lembaga Penyelesaian Perselisihan Hubungan Industrial. | |||||||||
