Abstract
The principle of quantitative restriction prohibition is the principle that each member state cannot apply import or export restrictions through quotas or licenses (import or export permits), but can only be done with a tariff system. However, in its settings there is an exception that sets it. In relation to Indonesia issuing the Regulation of the Minister of Energy and Mineral Resources Number 11 of 2019 concerning the ban on the export of nickel raw ore, the European Union considers that the policy taken by Indonesia has violated Article 11 paragraph (1) of GATT because it can hinder countries in the European region from having difficulty obtaining nickel raw materials. Identification The problem in this study is first, how is the principle setting of quantitative restrictions in DS-592 Disputes – Measures Relating to Raw Materials according to the WTO GATT? Secondly, Does the Indonesian government's policy on the DS-592 – Measures Relating to Raw Materials Dispute meet the provisions of the WTO GATT? This research uses the principle of permanent sovereignty over natural resources and the theory of sustainable development. This research was conducted using normative juridical research methods using secondary data sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques are carried out with literature studies and analysis used in this writing using qualitative analysis. The result of this study is that first, in the regulation of the principle of prohibition of quantitative restrictions in the 1994 GATT in the DS-592 dispute, there are exclusion provisions governing it. Second, the Government of Indonesia's policy regarding the regulation banning the export of nickel ore aims to implement good mining practices that are in line with the objectives of the theory of sustainable development. The suggestion from this research is that consistency and transparency from the Indonesian government are needed so that in issuing and implementing policies can ensure legal certainty and the sustainability of the domestic industry. Additional Information: | Prinsip larangan restriksi kuantitatif yakni prinsip yang menyatakan bahwa setiap negara anggota tidak boleh menerapkan pembatasan impor maupun ekspor melalui kuota atau lisensi (izin impor atau ekspor), tetapi hanya dapat dilakukan dengan sistem tarif. Meskipun demikian, dalam pengaturannya terdapat pengecualian yang mengaturnya. Sehubungan dengan Indonesia yang menerbitkan Peraturan Menteri Energi dan Sumber Daya Mineral (ESDM) Nomor 11 Tahun 2019 mengenai larangan ekspor bijih mentah nikel, Uni Eropa menilai bahwa kebijakan yang diambil Indonesia telah melanggar Pasal 11 ayat (1) GATT karena dapat menghambat negara-negara di kawasan Eropa kesulitan mendapatkan bahan baku nikel. Identifikasi Masalah dalam penelitian ini adalah pertama, bagaimanakah pengaturan prinsip larangan restriksi kuantitatif dalam Sengketa DS-592 – Measures Relating to Raw Materials menurut GATT WTO? Kedua, Apakah kebijakan pemerintah Indonesia dalam Sengketa DS-592 – Measures Relating to Raw Materials memenuhi ketentuan GATT WTO? Penelitian ini menggunakan prinsip kedaulatan permanen atas sumber daya alam dan teori pembangunan berkelanjutan. Penelitian ini dilakukan dengan menggunakan metode penelitian yuridis normatif dengan menggunakan sumber data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data dilakukan dengan studi kepustakaan dan analisis yang dipakai pada penulisan ini menggunakan analisis kualitatif. Hasil penelitian ini adalah pertama, dalam pengaturan prinsip larangan restriksi kuantitatif dalam GATT 1994 pada sengketa DS-592, terdapat ketentuan-ketentuan pengecualian yang mengaturnya. Kedua, kebijakan Pemerintah Indonesia terkait aturan pelarangan ekspor bijih nikel tidak lain bertujuan untuk menerapkan good mining practice yang sejalan dengan tujuan dari teori pembangunan berkelanjutan. Saran dari penelitian ini adalah dibutuhkan konsistensi dan transparansi dari pemerintah Indonesia supaya dalam mengeluarkan dan menerapkan kebijakan dapat menjamin kepastian hukum dan keberlangsungan industri dalam negeri.
