Abstract

The right to freedom of movement is a concept of human rights that includes the right of individuals to migrate or move from one place to another in a country. The right to freedom of movement is regulated in an international convention, namely ICCPR, Indonesia is one of the countries that has ratified the convention. The identification of the problem in this research is whether the right to freedom of movement can be limited according to the International Covenant On Civil and Political Rights (ICCPR)? And does the policy of restricting the right to freedom of movement for Indonesian citizens who refuse the Covid-19 vaccination contradict the International Covenant On Civil and Political Rights (ICCPR)? The theory used in this research is the theory of state sovereignty and the theory of law enforcement. The method used is a normative juridical research method by examining library materials and by using secondary data sources. The data collection technique was carried out by literature study and the analysis used in this paper using qualitative analysis by describing the subject or object of research. The results of the study can be concluded, the right to freedom of movement can be limited according to the ICCPR. In accordance with article 12 of the ICCPR which clearly stipulates that restrictions on the right to free movement can be carried out only for reasons of public health or a national emergency by meeting the criteria of lawful, necessary, and proportionate. The policy of restricting the right to freedom of movement for Indonesian citizens who refuse the Covid-19 vaccination does not conflict with the ICCPR. Based on article 4 of the ICCPR if the connection is with a health emergency to protect the Indonesian people from the Covid-19 outbreak, so based on the ICCPR International convention, Indonesia has the authority to make restrictions on human rights, in this case against Indonesian citizens who refuse vaccines.

Additional Information: Hak kebebasan bergerak (freedom of movement) adalah suatu konsep hak asasi manusia yang meliputi hak individu untuk merantau atau berpindah dari satu tempat ke tempat lainnya dalam sebuah negara. Hak kebebasan bergerak diatur dalam konvensi internasional yaitu ICCPR, Indonesia merupakan salah satu negara yang sudah meratifikasi konvensi tersebut. Identifikasi masalah dalam penelitian ini yaitu Apakah hak kebebasan untuk bergerak (freedom of movement) dapat dibatasi menurut International Covenant On Civil and Political Rights (ICCPR)? Dan Apakah kebijakan pembatasan hak kebebasan bergerak bagi warga negara Indonesia yang menolak vaksinasi Covid-19 bertentangan dengan International Covenant On Civil and Political Rights (ICCPR)? Teori yang digunakan dalam penelitian ini ialah teori kedaulatan negara dan teori penegakkan hukum. Metode yang digunakan yaitu metode penelitian yuridis normatif dengan cara meneliti bahan kepustakaan dan dengan menggunakan sumber data sekunder. Teknik pengumpulan data dilakukan dengan studi kepustakaan dan analisis yang dipakai pada penulisan ini menggunakan analisis kualitatif dengan cara memaparkan subjek atau objek penelitian. Hasil penelitian dapat disimpulkan, Hak kebebasan untuk bergerak (freedom of movement) dapat dibatasi menurut ICCPR. Sesuai dengan Pasal 12 ICCPR yang mengatur secara jelas bahwasanya restriksi terhadap hak bebas bergerak dapat dilakukan hanya dengan alasan kesehatan publik ataupun keadaan darurat nasional dengan memenuhi kriteria lawful, necessary, dan proportionate. Kebijakan pembatasan hak kebebasan bergerak bagi warga negara Indonesia yang menolak vaksinasi Covid-19 tidak bertentangan dengan ICCPR. Berdasarkan pasal 4 ICCPR apabila kaitannya adalah dengan kedaruratan kesehatan untuk melindungi bangsa Indonesia dari wabah Covid−19, sehingga berdasarkan konvensi Internasional ICCPR, Indonesia memiliki kewenangan untuk melakukan pembatasan terhadap hak-hak asasi manusia, dimana dalam hal ini terhadap warga negara Indonesia yang menolak vaksin.
