Abstract

The Covid-19 pandemic has caused crucial problems in industrial relations. After the issuance of Government Regulation of the Republic of Indonesia Number 21 of 2020 concerning Large-Scale Social Restrictions to tackle the spread of Covid-19. As a result of the many restrictions imposed, many companies are experiencing economic difficulties so they have laid off workers, as experienced by the three workers at Margalena Boutique. At the time of the layoffs, Margalena Boutique Owner only said that the company's finances were declining drastically due to the Covid-19 pandemic and the worker had to be laid off without providing clarity regarding the reasons for the force majeure used by the company and also regarding the rights that workers should receive. So that the identification of the problem in this research is how the validity of the layoffs carried out by Margalena Boutique Owner due to the Covid-19 pandemic and how is the legal protection for workers who were laid off by Margalena Boutique Owner due to the Covid-19 pandemic based on Law Number 13 of 2003 concerning Employment. The framework used in this study is the theory of legal protection. The method used in this study uses empirical juridical methods, with statutory, concept and case approaches. The data source used is primary data supported by secondary data, with primary data collection techniques in the form of interviews with laid-off workers, Margalena Boutique Owner and the Tangerang City Manpower Office as well as secondary data through library research. And data analysis in this writing is descriptive qualitative. Based on research data, the reason for the termination of employment by Margalena Boutique Owner was due to a decrease in the number of clothing orders due to the large-scale social restrictions of the Covid-19 pandemic so that the company experienced economic difficulties and the Owner was forced to terminate employment for reasons of force majeure. So that it can be concluded that the reason for the termination of employment by the Owner does not comply with the provisions of Article 164 paragraph (1) and procedures that are not in accordance with Article 151 paragraph (2), thus the termination of employment by the Margelena Boutique Owner for her workers is invalid and as for the legal protection provided is by re-employing the worker concerned or by providing compensation payments based on the Labor Law. As for suggestions from the author, if there is termination of employment, the mechanism for termination of employment must be in accordance with applicable regulations in order to avoid industrial relations disputes.

Additional Information: Pandemi Covid-19 menyebabkan masalah krusial dalam hubungan industrial. Setelah dikeluarkannya Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar guna menanggulangi penyebaran Covid-19. Akibat banyaknya pembatasan yang dilakukan, banyak perusahaan yang mengalami kesulitan ekonomi sehingga melakukan PHK, seperti yang dialami oleh ketiga pekerja di Butik Margalena. Pada saat pelaksanaan PHK, Pengusaha Butik hanya mengatakan bahwa keuangan perusahaan sedang menurun drastis akibat pandemi Covid-19 dan pekerja tersebut terpaksa harus diberhentikan tanpa memberikan kejelasan mengenai alasan force majeure yang dipakai perusahaan dan juga mengenai hak-hak yang seharusnya didapatkan pekerja. Sehingga identifikasi masalah dalam penelitian ini adalah bagaimana keabsahan PHK yang dilakukan oleh pengusaha Butik akibat pandemi Covid-19 serta bagaimana perlindungan hukum bagi pekerja yang di PHK oleh pengusaha Butik Margalena akibat pandemi Covid-19 berdasarkan Undang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan. Kerangka pemikiran yang digunakan pada penelitian ini yaitu teori perlindungan hukum. Metode yang digunakan menggunakan metode yuridis empiris, dengan pendekatan perundang-undangan, konsep dan kasus. Sumber data yang digunakan adalah data primer yang ditunjang data sekunder, dengan teknik pengumpulan data primer berupa wawancara serta data sekunder melalui studi kepustakaan. Dan analisis data dalam penelitian ini berupa deskriptif kualitatif. Berdasarkan data hasil penelitian bahwa alasan PHK yang dilakukan oleh Pengusaha Butik Margalena yaitu karena penurunan jumlah pesanan busana akibat PSBB pandemi Covid-19 sehingga perusahaan mengalami kesulitan ekonomi dan pengusaha terpaksa melakukan PHK dengan alasan force majeure. Sehingga dapat disimpulkan alasan PHK yang dilakukan oleh pengusaha tidak memenuhi ketentuan Pasal 164 ayat (1) serta prosedur yang tidak sesuai dengan Pasal 151 ayat (2), dengan demikian PHK yang dilakukan pengusaha Butik Margelena kepada pekerjanya adalah tidak sah dan adapun perlindungan hukum yang diberikan adalah dengan mempekerjakan kembali pekerja yang bersangkutan atau dengan memberikan pembayaran ganti rugi Berdasarkan Undang-Undang Ketenagakerjaan. Adapun saran dari penulis apabila terjadinya PHK, mekanisme PHK haruslah sesuai dengan ketentuan yang berlaku guna menghindari terjadinya perselisihan hubungan industrial.
