Abstract
The environment is the space occupied by humans and other living things. According toLaw no. 32 of 2009 Article 1 paragraph (2) Environmental Protection and Managementis a systematic and integrated effort carried out to preserve environmental functionsand prevent environmental pollution and/or damage which includes planning,utilization, control, maintenance, supervision, and enforcement. law. DistrictGovernment. Pandeglang has made regulations on B3 which regulates so as not toharm the community because it can pollute the environment, damage the environment,endanger the environment, health and survival. Based on this background, theresearchers discussed how the government supervises the disposal of B3 waste in Pandeglang Regency according to Government Regulation no. 22 of 2021Implementation of Environmental Protection and Management? And how are thesanctions imposed by the government on companies in Pandeglang district that do nothave permits according to Government Regulation No. 22 of 2021 on theImplementation of Environmental Protection and Management? The framework used in this research is the Theory of Law Enforcement and Theory of Legal Supervision. Theresearch method used in answering the research problem is the sociological empiricaljuridical method which is sourced from primary data and secondary data. Legal supervision is the process of carrying out activities to ensure that organizational and management objectives are achieved. This relates to ways of making activities according to the plan with the instructions that have been given and with the principles that have been outlined, in order to create legal goals. Legal supervision in state administrative law includes 3 types of supervision, namely: preliminary supervision, supervision carried out together with the implementation of activities, feedback supervisionin order to create a legal purpose. Legal supervision in state administrative law includes 3 types of supervision Judging from its type, this supervision has three types of supervision, namely: Preliminary supervision, Supervision carried out together with the implementation of activities, Supervision of feedback. Wawan Munawar as the Head of Hygiene and Waste Affairs explained that there are inhibiting factors in law enforcement sanctions for business actors who violate regulations, including: Internal factors and External factors.

| Additional Information: | Lingkungan hidup adalah ruang yang ditempati oleh manusia bersama makhluk hidup lainnya. Menurut UU No. 32 tahun 2009 pasal 1 ayat (2) Perlindungan dan Pengelolaan Lingkungan Hidup adalah upaya sistematis dan terpadu yang dilakukan untuk melestarikan fungsi lingkungan hidup dan mencegah terjadinya pencemaran dan/atau kerusakan lingkungan hidup yang meliputi perencanaan, pemanfaatan, pengendalian, pemeliharaan, pengawasan, dan penegakan hukum. Pemerintah Kab. Pandeglang telah membuat peraturan tentang B3 yang mengatur agar tidak merugikan masyarakat karena dapat mencemarkan lingkungan, merusak lingkungan, membahayakan lingkungan, Kesehatan serta kelangsungan hidup. Berdasarkan latar belakang tersebut peneliti membahas tentang Bagaimana pengawasan pemerintah terhadap pembuangan limbah B3 di Kabupaten Pandeglang menurut Peraturan Pemerintah No. 22 Tahun 2021 Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup? Dan Bagaimana penerapan sanksi yang dilakukan pemerintah terhadap perusahaan di kabupaten Pandeglang yang tidak memiliki izin menurut Peraturan Pemerintah Nomor 22 Tahun 2021 Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup? Kerangka pemikiran yang digunakan dalam penelitian ini ialah Teori Penegakan Hukum dan Teori Pengawasan Hukum. Metode penelitian yang digunakan dalam menjawab permasalah penelitian ialah metode yuridis empiris sosiologis yang bersumber dari data primer dan data sekunder. Pengawasan hukum adalah proses dilakukannya kegiatan untuk menjamin bahwa tujuan organisasi dan manajemen tercapai. Ini berkenaan dengan cara-cara membuat kegiatan sesuai yang di rencanakan dengan instruksi yang telah diberikan dan dengan prinsip-prinsip yang telah digariskan, agar terciptanya tujuan hukum. Pengawasan hukum dalam hukum administrasi negara meliputi 3 tipe pengawasan, yaitu: Pengawasan pendahuluan, Pengawasan yang dilakukan bersama dengan pelaksanaan kegiatan, Pengawasan umpan balik. Kepala Bidang Kebersihan dan Persampahan menjelaskan bahwa terdapat faktor- faktor penghambat dalam penegakan hukum, sanksi admnistrasi pelaku usaha yang melanggar peraturan antara lain: Faktor internal dan Faktor ekternal. | |||||||||
