Abstract
The presence of foreigners besides bringing benefits, they can also cause things that are detrimental to the interests of the country in which they are located. In fact, this can endanger the peace and security of the country. If this happens, then for countries that feel disturbed by the foreigners, immigration measures can be taken, namely deportation. However, deportation cannot be carried out arbitrarily. Identification of the problems in this study, namely first, what are the arrangements regarding the deportation of foreign nationals in the International Covenant on Civil and Political Rights? Second, is Christian Gray's deportation against the International Covenant on Civil and Political Rights? The theory used in this research is the theory of state sovereignty and law enforcement theory. The research method used is a normative juridical research method using secondary data sources consisting of primary book materials, secondary book materials, and tertiary book materials. The data collection technique was carried out by means of a literature study and the analysis used in this paper uses qualitative analysis by describing or describing the subject or object of the research. The findings obtained from this research are arrangements regarding the deportation of foreign nationals in a country in the International Covenant on Civil and Political Rights. The results of this study are first, the deportation of foreign nationals in a country is regulated in articles 9, 12, 13 and 26 of the International Covenant on Civil and Political Rights. Second, in accordance with these regulations, the deportation of Kristen Gray has been carried out in accordance with existing regulations. The advice that the author can convey is the need for awareness by foreign citizens who wish to visit Indonesia to complete the specified requirements and live in accordance with the permits obtained. As well as the importance of monitoring by the immigration authorities for foreign nationals who are in Indonesia to ensure that no foreign national violates the provisions in Indonesia.

| Additional Information: | Kehadiran orang asing selain membawa hal yang menguntungkan, mereka juga dapat menimbulkan hal yang merugikan bagi kepentingan negara dimana mereka berada. Bahkan hal tersebut dapat membahayakan ketentraman dan keamanan negara. Jika terjadi demikian, maka bagi negara yang merasa terganggu akibat orang asing tersebut dapat dilakukan tindakan keimigrasian yaitu pendeportasian. Namun, pelaksanaan pendeportasian tidak dapat dilakukan secara sewenang-wenang. Identifikasi masalah dalam penelitian ini yaitu pertama, bagaimana pengaturan terkait pendeportasian warga negara asing dalam International Covenant on Civil and Political Rights? Kedua, apakah tindakan Pendeportasian Kristen Gray bertentangan dengan International Covenant on Civil and Political Rights?. Teori yang digunakan dalam penelitian ini adalah teori kedaulatan negara dan teori penegakan hukum. Metode penelitian yang digunakan yaitu metode penelitian yuridis normatif dengan menggunakan sumber data skunder yang terdiri dari bahan buku primer, bahan buku sekunder, dan bahan buku tersier. Teknik pengumpulan data dilakukan dengan studi kepustakaan dan analisis yang dipakai pada penulisan ini menggunakan analisis kualitatif dengan cara menggambarkan atau memaparkan subjek atau objek penelitian. Temuan yang diperoleh dari penelitian ini adalah pengaturan terkait pendeportasian warga negara asing di suatu negara dalam International Covenant on Civil and Political Rights. Hasil penelitian ini adalah pertama, pendeportasian warga negara asing di suatu negara diatur pada pasal 9, 12, 13 dan 26 International Covenant on Civil and Political Rights. Kedua, sesuai dengan peraturan tersebut pendeportasian Kristen Grey sudah dilakukan sesuai dengan peraturan yang ada. Saran yang dapat penulis sampaikan yaitu perlunya kesadaran oleh warga negara asing yang ingin berkunjung ke Indonesia untuk melengkapi persyaratan yang telah ditentukan dan tinggal sesuai dengan izin yang didapatkan. Serta pentingnya pemantauan oleh pihak keimigrasian terhadap warga negara asing yang berada di Indonesia untuk memastikan tidak ada warga negara asing yang melanggar ketentuan yang ada di Indonesia. | |||||||||
