Abstract

LAW ENFORCEMENT AGAINST THE CRIME OF THE WITH VIOLENCE IN THE SERANG POLICE AREA CITY (STUDI OF DECISION NUMBER 1126/PID.B/2020/PN SRG) Anisa Natalia Peirisa 1111180027 ABSTRACT The law has the function of ordering and regulating social relations in society. Many efforts have been made by law enforcers to reduce the rate of growth in crime rates, but crimes still occur frequently, especially in the City of Serang, one of which is the crime of theft with violence as regulated in Article 365 of the Criminal Code.  the crime caused material losses to the people who were victims. As in cases that have already been decided, there was a crime of theft with violence with the mode of slashing the victim, so that the victim suffered broken bones, open wounds on the upper and lower left arms, severed arteries, nerves,  tendons.  From these problems, the researcher focuses on examining how law enforcement by police officers is against the crime of theft with violence in the Serang City Police area (Study of Decision Number 1126/Pid.B/2022/PN Srg) and how the efforts of the public prosecutor in prosecuting the accused perpetrator of the crime of theft  by force in terms of the Theory of Legal Effectiveness.  The theory used is the Theory of Criminal Law Enforcement and the Effectiveness of Criminal Law.  Using qualitative methods and normative juridical approaches which refer to legal norms, laws and regulations, court decisions, and are analytically descriptive in nature, namely describing data obtained from interviews.  Based on the results of the research, it was found that law enforcement was carried out by the police using preventive, pre-emptive and repressive actions.  Then in terms of effectiveness the public prosecutor's efforts to prosecute the defendant for 6 years in prison have not been fully effective and have not created a deterrent effect, this can be seen from the cases that still exist every year.  In this case the police must increase supervision before the crime of theft with violence occurs and the public prosecutor should be more careful in prosecuting the defendant in the crime of theft with violence. Dari permasalahan tersebut peneliti fokus menelaah Bagaimana Penegakan Hukum Oleh Aparat Kepolisian Terhadap Tindak Pidana Pencurian Dengan Kekerasan Di Wilayah Polres Serang Kota (Studi Putusan Nomor 1126/Pid.B/2022/PN Srg) dan Bagaimana Upaya Penuntut Umum Dalam menuntut Terdakwa Pelaku Tindak Pidana Pencurian dengan kekerasan ditinjau dari Teori Efektifitas Hukum. Teori yang digunakan adalah Teori Penegakan Hukum Pidana dan Efektifitas Hukum Pidana. Menggunakan metode kualitatif dan pendekatan yuridis normatif yang mana mengacu pada norma-norma hukum, peraturan perundang-undangan, putusan pengadilan, dan bersifat deskriptif analitis yakni mendeskripsikan data yang diperoleh dari hasil wawancara. Berdasarkan hasil penelitian diperoleh bahwa penegakan hukum yang dilakukan oleh aparat kepolisian yaitu dengan tindakan preventif, preemtif, dan represif. Kemudian dalam Efektifitas Upaya penuntut umum dalam menuntut terdakwanya dengan tuntutan 6 tahun penjara, belum sepenuhnya efektif dan belum menimbulkan efek jera hal tersebut bisa dilihat dari kasus kasusnya yang masih ada di setiap tahunnya. Dalam hal ini pihak kepolisian harus lebih meningkatkan pengawasan sebelum terjadinya tindak pidana pencurian dengan kekerasan dan sebaiknya Jaksa penuntut umum lebih cermat dalam menuntut terdakwa kasus tindak pidana pencurian dengan kekerasan.
