Abstract

State responsibility arises when there is a violation of an international obligation to do something, whether the obligation is based on international agreements or based on international customs The state has important functions, especially regulating the protection of medical personnel in armed conflicts that existed at the Geneva Convention I 1949 and Additional Protocol I 1977. The problem is first, How is the implementation of the protection of medical teams in international armed conflicts according to Additional Protocol I 1977, second how does the responsibility of the state of Israel form in the case study of the shooting of medical officer Razzan Al-Najjar in the gaza Strip in an international armed conflict according to Supplementary Protocol I 1977. The theory used is theory of state responsibility and the principle of distinction. This study was conducted using normative juridical method with secondary data sources consisting of primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques are carried out with literature studies and research analysis used by researchers is qualitative analysis by describing the subject and object of research. As for the results of this study is the first, in Additional Protocol I 1977 article 12 paragraph 1 which states that health units must be respected and protected at all times and also should not be subjected to war.. Second, a state is responsible for providing full reparation of losses incurred by the internationally wrongful acts. Full reparation is meant in the form of restitution, compensation, punishment of persons who should be responsible, apology or satisfaction or any combination thereof. Its conclusion the implementation of the protection of medical teams in international armed conflicts according to Supplementary Protocol I 1977 is not carried out and the state of Israel is not responsible for the shooting of such medical teams. Advice requires a good faith and mutual commitment from the parties to the dispute in earnest to prioritize the protection of medical teams based on the provisions of international humanitarian law in force.

Additional Information:	Tanggung jawab negara timbul bila terdapat pelanggaran atas suatu kewajiban internasional untuk berbuat sesuatu, baik kewajiban tersebut berdasarkan perjanjian internasional maupun berdasarkan pada kebiasaan internasional. Negara mempunyai fungsi yang cukup penting, khususnya mengatur perlindungan terhadap petugas medis dalam konflik bersenjata yang ada pada Konvensi Jenewa I 1949 dan Protokol Tambahan I 1977. Masalahnya adalah pertama, bagaimana pelaksanaan perlindungan terhadap tim medis dalam konflik bersenjata internasional menurut Protokol tambahan I 1977, kedua bagaimana bentuk tanggung jawab negara Israel dalam studi kasus penembakan petugas medis Razzan Al-Najjar di jalur gaza dalam konflik bersenjata internasional menurut Protokol tambahan I 1977. Teori yang digunakan adalah teori tanggung jawab negara dan prinsip pembedaan. Penelitian ini dilakukan dengan menggunakan metode yuridis normatif dengan sumber data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data dilakukan dengan studi kepustakaan serta analisis penelitian yang dipakai peneliti ialah analisis kualitatif dengan memaparkan subjek serta objek penelitian. Adapun hasil dari penelitian ini adalah pertama, dalam Protokol Tambahan I 1977 Pasal 12 Ayat 1 yang menyatakan bahwa satuan-satuan kesehatan harus setiap saat dihormati dan dilindungi dan juga tidak boleh dijadikan sasaran perang. Kedua, Suatu negara bertanggung jawab untuk memberikan full reparation terhadap kerugian yang ditimbulkan oleh the internationally wrongful acts. Full reparation yang di maksudkan dalam bentuk restitusi, kompensasi, penghukuman terhadap orang-orang yang seharusnya bertanggung jawab, permintaan maaf atau pemuasan atau kombinasi dari kesemuanya. Kesimpulan nya pelaksanaan perlindungan tim medis dalam konflik bersenjata internasional menurut protokol tambahan I 1977 adalah tidak terlaksana dan negara Israel tidak bertanggung jawab atas penembakan tim medis tersebut. Saran di butuhkan sebuah itikad baik dan komitmen bersama dari pihak yang bersengkata secara sungguh untuk mengutamakan perlindungan tim medis berdasarkan ketentuan hukum humaniter internasional yang berlaku.
