Abstract
The house is a basic human right, both individually and as a unit and together with nature and the environment. The presence of various developments for rented flats (RUSUNAWA) and owned flats (RUSUNAMI) is an indication of the developer's strong enthusiasm for government programs. The perpetrators of the construction of flats are required to complete the environment of the flats with infrastructure, facilities and public utilities in accordance with Article 40 of Law Number 11 of 2020 concerning Job Creation. As for identifying the problem, what is the authority of the DKI Jakarta Government in managing infrastructure, facilities and public utilities for Klender flats based on Law Number 11 of 2020 Concerning Job Creation? And what are the inhibiting factors in managing infrastructure, facilities and public utilities for Klender flats? The theory used is the theory of authority and welfare theory. The research method is empirical juridical. The research specification is descriptive analysis. The data source is primary data which is supported by secondary data. Data collection techniques are interviews and documents related to research. The data were obtained and analyzed descriptively using a qualitative approach. The results of the study regarding the authority of the Government of DKI Jakarta in managing the infrastructure, facilities and public utilities of the Klender flats are to supervise and control. The inhibiting factors in managing the infrastructure, facilities and public utilities of Klender flats are the lack of coordination between the Provincial Government and Klender flat managers, the roles of residents who do not fully support each other and there is no direction from the Regional Government to the managers of Klender flats. The conclusion is that based on the authority that has been set by the Regional Government, it has not fully exercised its authority properly because there is no direct supervision by the government of the Klender Flats manager. The suggestion is that the Regional Government should pay more attention to the infrastructure, facilities and public utilities of Klender flats, increasing the budget so that the infrastructure, facilities and public utilities of Klender flats which are already damaged or unfit for use can be replaced immediately.

| Additional Information: | Rumah merupakan hak dasar manusia, baik secara perorangan maupun dalam satu kesatuan dan kebersamaan dengan alam dan lingkungannya.Hadirnya beragam pembangunan rumah susun sewa (RUSUNAWA) dan rumah susun hal milik (RUSUNAMI) adalah salah satu indikasi kuatnya antusias para pengembang terhadap program pemerintah. Pelaku pembangunan rumah susun wajib melengkapi lingkungan rumah susun dengan prasarana, sarana dan utilitas umum sesuai dengan Pasal 40 Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Adapun identifikasi masalahnya, bagaimana kewenangan Pemerintah DKI Jakarta dalam pengelolaan prasarana, sarana dan utilitas umum rumah susun Klender berdasarkan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja? Dan apa faktor penghambat dalam mengelola prasarana, sarana dan utilitas umum rumah susun Klender?. Teori yang digunakan yaitu teori kewenangan dan teori kesejahteraan. Metode penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis. Sumber data yaitu data primer yang di tunjang oleh data sekunder. Teknik pengumpulan data adalah wawancara dan dokumen yang terkait dengan penelitian. Data diperoleh dan dianalisis secara deskriptif dengan metode pendekatan kualitatif. Hasil penelitian mengenai kewenangan Pemerintah DKI Jakarta dalam pengelolaan prasarana, sarana dan utilitas umum rumah susun Klender yaitu melakukan pengawasan dan pengendalian. Faktor penghambat dalam mengelola prasarana, sarana dan utilitas umum rumah susun Klender yaitu kurangnya koordinasi antara Pemerintah Daerah provinsi dengan pengelola rumah susun Klender,peran penghuni yang belum sepenuhnya mendukung satu sama lain dan tidak ada pengarahan dari pihak Pemerintah Daerah kepada para pengelola rumah susun Klender. Kesimpulannya adalah berdasarkan kewenangan yang telah di tetapkan Pemerintah Daerah belum sepenuhnya melakukan kewenangannya dengan baik dikarenakan tidak ada pengawasan langsung oleh pemerintah terhadap pengelola rumah susun klender. Sarannya adalah Pemerintah Daerah harus lebih memperhatikan prasarana, sarana dan utilitas umum rumah susun Klender, meningkatkan anggaran agar prasarana, sarana dan utilitas umum rumah susun Klender yang sudah rusak atau tidak layak pakai bisa segera diganti | |||||||||
