Abstract
Cinematography is a protected creation. In the world of cinema, there are adaptations of cinematographic works, namely works that are shown with the manifestation of creation into other forms, for example, the drama series My Lecturer My Husband. When the premiere of the first episode of this drama series there has been piracy and the video was circulating on several social media sites illegally. Based on this background, the writer takes two identification problems. First: How is the legal protection against MD Entertainment as the owner and copyright holder for the act of piracy of the drama series My Lecturer My Husband on TikTok social media. Second: How is the responsibility of the account owners Agryamsssssss and Miszpanda for the act of piracy of the drama series My Lecturer My Husband on TikTok social media. The theories used are the Theory of Legal Protection and the Theory of Legal Responsibility. The method used is a normative juridical approach with the Statute Approach and the Conceptual Approach. The data used as writing material in this study were taken from secondary data through library research and primary data through interviews. The data analysis used is a qualitative analysis by summarizing, categorizing, and interpreting. The results obtained in this study are: One, Legal protection to MD Entertainment for the act of hijacking the drama series My Lecturer My Husband has not been given by TikTok, because only the users of the TikTok platform are given direct protection. Second, moral responsibility is only carried out by the account owner @miszpanda by uploading a video inviting his followers on TikTok to watch the drama My Lecturer My Husband Season 2 on WeTV legal application to watch, while the account owner @agryamsssssss does not perform moral responsibility. The economic responsibility is not carried out by the two account owners because there has been no lawsuit from MD Entertainment. TikTok social media should carry out its obligation to provide equal legal protection both to users and to creators or copyright holders in accordance with applicable laws and regulations. Users should increase their self-awareness of the applicable regulations so that in the future they do not create content that can take away rights and harm others.

Dalam dunia perfilman terdapat adaptasi karya sinematografi, yaitu karya yang ditampilkan dengan manifestasi suatu ciptaan ke dalam bentuk lain, misalnya serial drama My Lecturer My Husband. Saat penayangan perdana episode pertama serial drama ini telah terjadi pembajakan dan videonya telah beredar di beberapa situs media sosial secara ilegal. Berdasarkan latar belakang tersebut, penulis mengambil dua identifikasi masalah. Pertama: Bagaimana perlindungan hukum terhadap MD Entertainment sebagai pemilik sekaligus pemegang Hak Cipta atas tindakan pembajakan drama series My Lecturer My Husband di media sosial TikTok. Kedua: Bagaimana tanggung jawab pemilik akun Agryamsssssss dan Miszpanda atas tindakan pembajakan drama series My Lecturer My Husband di media sosial TikTok. Teori yang digunakan adalah Teori Perlindungan Hukum dan Teori Tanggung Jawab Hukum. Metode yang digunakan adalah pendekatan yuridis normatif dengan Pendekatan Perundang-Undangan (Statute Approach) dan Pendekatan Konseptual (Conceptual Approach). Data yang digunakan sebagai bahan penulisan dalam penelitian ini diambil dari data sekunder melalui studi kepustakaan dan data primer melalui wawancara. Analisis data yang digunakan adalah analisis kualitatif dengan cara merangkum, mengkategorikan dan menginterpretasikan. Hasil yang diperoleh dalam penelitian ini adalah: Satu, Perlindungan hukum kepada MD Entertainment atas tindakan pembajakan serial drama My Lecturer My Husband belum diberikan oleh TikTok, karena yang diberikan perlindungan secara langsung hanyalah para pengguna platform TikTok. Kedua, Tanggung jawab secara moral hanya dilakukan oleh pemilik akun @miszpanda saja dengan cara mengunggah video mengajak para pengikutnya di TikTok untuk menonton drama My Lecturer My Husband Season 2 di WeTV aplikasi legal untuk menonton, sedangkan pemilik akun @agryamsssssss tidak melakukan tanggung jawab secara moral. Tanggung jawab secara ekonomi tidak dilakukan oleh kedua pemilik akun karena belum ada tuntutan hukum dari MD Entertainment. Hendaknya media sosial TikTok menjalankan kewajiban untuk memberikan perlindungan hukum yang setara baik kepada pengguna maupun kepada pencipta atau pemegang hak cipta sesuai dengan peraturan perundang-undangan yang berlaku. Hendaknya pengguna harus meningkatkan kesadaran diri terhadap peraturan yang berlaku agar kedepannya tidak membuat konten yang dapat mengambil hak dan merugikan orang lain. | |||||||||
