Abstract

Indonesian criminal law outlines the factors that led to the occurrence of murder that caused the perpetrator to be convicted because there was intentional and negligence. An important element in negligence is that the perpetrator has an awareness that the perpetrator can suspect that the consequences of his actions will cause an effect that is prohibited by law. Because this form of error is also mentioned in the formulation of the offense, it must also be proven. Therefore, the researcher will discuss about what factors cause resistance and lead to death by victims of domestic violence? and analysis of criminological theory on the crime of murder committed by victims of domestic violence?. And how the theories used are Violence Cycle Theory and Psychoanalytic Theory. The research method used is normative juridical, namely the study of law which is conceptualized as what is written in the legislation. The results of this study, that the factors that cause the occurrence of these crimes are due to lack of knowledge on how to establish a good household relationship and economic incapacity as well as psychological factors. Because the cause of the crime of resistance that resulted in death in cases of domestic violence is due to the ego factor which is more inclined to the Id aspect than the superego aspect, so that it is not able to balance the mind in tackling the inner conflicts that occur. Thus, domestic violence in this case stopped at the Regret Phase because the acts of violence committed by the perpetrator received resistance from the victim, which ultimately caused the perpetrator to die. The resistance is due to psychological, educational, economic factors, and the failure of the superego aspect which causes the ego aspect to be more dominant to the Id aspect. The advice given by the author is the importance of education related to domestic violence that is formal or non-formal, as well as providing economic programs which are one of the most influential factors in people's lives that can cause causes and effects of crime.

Additional Information:	Hukum pidana indonesia menguraikan faktor berlangsungnya pembunuhan hingga menyebabkan pelakunya dipidana ialah sebab terdapat kesengajaan serta kelalaian. Unsur penting dalam kelalaian adalah pelaku mempunyai kesadaran yang mana pelaku dapat menduga akibat dari perbuatannya itu akan menimbulkan suatu akibat yang dilarang undang-undang. Oleh karena bentuk kesalahan ini juga disebut dalam rumusan delik, maka juga harus dibuktikan. Maka dari itu, peneliti akan membahas tentang faktor-faktor apa saja yang menyebabkan terjadinya perlawanan dan mengakibatkan kematian yang dilakukan oleh korban kekerasan dalam rumah tangga? dan bagaimana analisa teori kriminologi terhadap tindak pidana pembunuhan yang dilakukan korban kekerasan dalam rumah tangga?. Adapun teori yang digunakan, yaitu Teori Siklus Kekerasan dan Teori Psikoanalisa. Metode penelitian yang digunakan adalah yuridis normatif, yaitu pengkajian hukum yang dimana dikonsepkan sebagai apa yang tertulis dalam peraturan perundang-undangan. Hasil penelitian ini, bahwa faktor-faktor yang menyebabkan terjadinya tindak pidana tersebut dikarenakan kurangnya pengetahuan terhadap cara menjalin sebuah hubungan rumah tangga yang baik dan ketidakmampuan secara ekonomi serta faktor psikologi. Oleh karena penyebab terjadinya tindak pidana perlawanan yang mengakibatkan kematian pada kasus kekerasan dalam rumah tangga ini dikarenakan faktor ego yang lebih condong kepada aspek Id daripada aspek superego, sehingga tidak mampu menjadi penyeimbang pikiran dalam menanggulangi konflik batin yang terjadi. Dengan demikian, Kekerasan dalam rumah tangga pada kasus ini berhenti di Fase Penyesalan dikarenakan tindakan kekerasan yang dilakukan oleh pelaku mendapat perlawanan dari korban, yang akhirnya menyebabkan pelaku ini meninggal. Perlawanan tersebut dikarenakan faktor psikologi, pendidikan, ekonomi, serta Kegagalan aspek superego yang menyebabkan aspek ego lebih dominan kepada aspek Id. Saran yang diberikan penulis adalah pentingnya edukasi terkait Kekerasan Dalam Rumah Tangga yang bersifat formal ataupun non formal, serta memberikan program perekonomian yang merupakan salah satu faktor paling berpengaruh dalam kehidupan masyarakat yang dapat menimbulkan sebab-akibat terjadinya kejahatan.
