Abstract

State Administrative Dispute is a dispute that arises in the field of State Administration between a person or civil legal entity with a State Administration Agency or Official, both at the center and in the region, as a result of which a State Administrative Decree is issued. The basis of the dispute in this study is a Ministerial Decree Law and Human Rights Number M.HH-01.KP.07.03 of 2021 concerning Respectful Dismissal as a Civil Servant due to a criminal act on January 04, 2021. As for the identification of the problem, what is the legal position of respectful dismissal of a civil servant based on Decision Number 81/G /2021/PTUN.JKT?, then what is the basis of the panel of judges in deciding the settlement of the dispute by granting the petition of the plaintiff?. The theory used is the Theory of State Administrative Dispute Resolution and Government Action Theory. The method used in this research is normative juridical with an approach based on laws and regulations and court decisions. Sources of data used in this study are data obtained from Decision Number 81/G/2021/PTUN.JKT and supporting data in the form of library materials as primary legal materials, namely laws, books, journals and other reference data. The results of this study were based on the judge's consideration in the Decision of the State Administrative Court Number 81/G/2021/PTUN.JKT was declared juridical because it violated the principle of accuracy and inappropriate procedures based on the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 28 of 2019 concerning Governance Method of Imposing Disciplinary Sentences and Dismissal for Criminal Acts for Employees in the Ministry of Law and Human Rights. The conclusion of this study, the State Administrative Court annulled the Decree of the Minister of Law and Human Rights Number M.HH-01.KP.07.03 and reactivated Suryansah Usmarianto as a Civil Servant at the Kemenkumham Jambi Fathers Board based on the judge's consideration in the Decision of the State Administrative Court Number 81/G/2021/PTUN.JKT. Suggestions based on the decision, State Administrative Officers in conducting trial examinations for violations of the code of ethics must be based on Procedural Principles and Accuracy Principles and meet the formal requirements in procedural law.

Additional Information: Sengketa Tata Usaha Negara adalah sengketa yang timbul dalam bidang Tata Usaha Negara antara orang atau badan hukum perdata dengan Badan atau Pejabat Tata Usaha Negara, sebagai akibatnya dikeluarkan Keputusan Tata Usaha Negara, Dasar sengketa dalam penelitian ini adalah Keputusan Menteri Hukum dan Hak Asasi Manusia Nomor M.HH-01.KP.07.03 Tahun 2021 tentang Pemberhentian Dengan Hormat Sebagai Pegawai Negeri Sipil karena tindak pidana tanggal 04 Januari 2021. Adapun Identifikasi masalahnya, Bagaimana Kedudukan Hukum Pemberhentian PNS Secara Hormat Berdasarkan Putusan Nomor 81/G/2021/PTUN.JKT?, kemudian Apa Dasar Majelis Hakim Dalam Memutus Penyelesaian Sengketa Dengan Mengabulkan Permohonan Penggugat?. Teori yang digunakan yaitu Teori Penyelesaian Sengketa Tata Usaha Negara dan Teori Tindakan Pemerintah. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan berdasarkan peraturan perundang undangan dan putusan pengadilan. Sumber data yang digunakan dalam penelitian ini adalah data yang diperoleh dari Putusan Nomor 81/G/2021/PTUN.JKT dan data penunjang berupa bahan-bahan Pustaka sebagai bahan hukum primer yaitu Undang-Undang, buku, jurnal dan data referensi lainnya. Hasil penelitian ini berdasarkan pertimbangan hakim dalam Putusan Pengadilan Tata Usaha Negara Nomor 81/G/2021/PTUN.JKT dinyatakan cacat yuridis karena melanggar asas kecermatan dan prosedur yang tidak sesuai berdasarkan Peraturan Menteri Hukum dan Hak Asasi Manusia Republik Indonesia Nomor 28 Tahun 2019 tentang Tata Cara Penjatuhan Hukuman Disiplin dan Pemberhentian Karena Tindak Pidana Bagi Pegawai di Lingkungan Kementerian Hukum dan Hak Asasi Manusia. Kesimpulan dari penelitian ini, Pengadilan Tata Usaha Negara membatalkan Keputusan Menteri Menteri Hukum dan Hak Asasi Manusia Nomor M.HH�01.KP.07.03 dan mengaktifkan Kembali Suryansah Usmarianto sebagai Pegawai Negeri Sipil di Bapas Kemenkumham Jambi berdasarkan pertimbangan Hakim dalam Putusan Pengadilan Tata Usaha Negara Nomor 81/G/2021/PTUN.JKT. Saran berdasarkan Putusan tersebut, Pejabat Tata Usaha Negara dalam melakukan pemeriksaan persidangan pelanggaran kode etik harus didasarkan Asas Prosedural serta Asas Kecermatan dan memenuhi syarat formil dalam hukum acara.
