Abstract
The Law on Trademarks and Geographical Indications has provided legal protection for registered marks. Brand problems in Indonesia always appear and never stop. Brand cases occur, related to the similarities in essence, either with well-known brands or with ordinary brands. The motive is motivated by bad faith. Identify the problem, how is the legal protection for the owner of the first registered mark in Indonesia according to the Trademark Law and Geographical Indications and is the judge's consideration in giving a decision in the Predator trademark dispute in the Supreme Court's decision Number 1146K/Pdt.Sus-HKI/2020 in accordance with the law -Invite Trademarks and Geographical Indications. The theory used is the theory of legal protection and legal certainty. The research method, normative juridical with legislation research specifications, conceptual approach and case approach. Sources of data, secondary data and primary data using data collection techniques and literature studies and field studies and analyzed descriptively qualitatively. The results of the study: Legal protection for the owner of the first registered mark in the case of the Predator mark based on the registration system in Indonesia which adheres to a constitutive system. In the constitutive system, registered trademarks are entitled to legal protection. A person who pre-registers a mark can use the mark. And the state does not allow other parties to register a mark that has similarities in principle with a previously registered mark for similar goods or services. The judge in giving legal considerations in the Supreme Court Decision Number 1146K/Pdt.Sus-HKI/2020 in the Predator case saw this case related to the fame of the Plaintiff's Predator brand. Whereas the Plaintiff's Predator mark is only registered in a few countries. The Panel of Judges seemed to override the provisions of the constitutive system adopted in the Law on Marks and Geographical Indications. Permasalahan merek di Indonesia senantiasa muncul dan tidak pernah berhenti. Kasus merek terjadi, terkait adanya persamaan pada pokoknya, baik dengan merek terkenal ataupun dengan merek biasa. Motif dilatarbelakangi oleh itikad tidak baik. Identifikasi masalah, Bagaimana perlindungan hukum terhadap pemilik merek terdaftar pertama di Indonesia menurut Undang-Undang Merek dan Indikasi Geografis dan Apakah pertimbangan Hakim dalam memberikan putusan dalam sengketa merek Predator di dalam putusan Mahkamah Agung Nomor 1146K/Pdt.Sus-HKI/2020 sudah sesuai Undang-Undang Merek dan Indikasi Geografis. Teori yang digunakan teori perlindungan hukum dan kepastian hukum. Metode penelitian, yuridis normatif dengan spesifikasi penelitian perundang-undangan, pendekatan konseptual dan pendekatan kasus. Sumber data, data sekunder dan data primer dengan menggunakan teknik pengumpulan data dan studi kepustakaan dan studi lapangan serta dianalisis secara deskriptif kualitatif. Hasil penelitian: Perlindungan hukum terhadap pemilik merek terdaftar pertama dalam kasus merek Predator berdasarkan sistem pendaftaran di Indonesia yang menganut sistem konstitutif. Dalam sistem konstitutif, merek yang sudah terdaftar berhak atas perlindungan hukum. Seseorang yang mendaftarkan lebih dulu sebuah merek dapat menggunakan merek tersebut. Serta negara tidak mengizinkan pihak lain mendaftarkan merek yang memiliki persamaan pada pokoknya dengan merek yang telah didaftarkan terlebih dahulu untuk barang atau jasa sejenisnya. Hakim dalam memberikan pertimbangan hukum dalam Putusan Mahkamah Agung Nomor 1146K/Pdt.Sus-HKI/2020 pada kasus Predator melihat kasus ini terkait keterkenalan merek Predator milik Penggugat. Padahal merek Predator milik Penggugat hanya terdaftar di beberapa Negara. Majelis Hakim terkesan mengesampingkan ketentuan sistem konstitutif yang dianut dalam Undang-Undang Merek dan Indikasi Geografis.
