Abstract

The abolition of the Mortgage Right can be done in a partial way or also called Partial Roya as regulated in Article 2 of the Mortgage Law. However, the enactment of the Regulation of the Minister of State for Agrarian Affairs Number 3 of 1997 is very much against the provisions of Roya and Partial Roya as stipulated in Article 2 of the Mortgage Law. This situation certainly causes problems, because there are different arrangements in eliminating the encumbrance of Mortgage Rights. In this study, we will discuss the implementation of Partial Roya in guaranteeing Mortgage Rights, especially what happened at the Office of the National Land Agency of Cilegon City after the enactment of the Regulation of the State Minister of Agrarian Affairs/Head of the National Land Agency Number 3 of 1997 and what obstacles were faced by the Office of the National Land Agency. Cilegon City in the implementation of Roya Partial Mortgage after the enactment of the Regulation of the State Minister of Agrarian Affairs/Head of the National Land Agency Number 3 of 1997. This study uses the theory of legal certainty. Furthermore, the research method used is normative juridical, with descriptive analysis specifications, the data source is secondary data supported by primary data, data collection techniques in the form of library research and field research, data analysis with qualitative analysis and research locations at the Office of the National Land Agency Cilegon City , As for the research that the author did, it was found that, based on the results of interviews with the Office of the National Land Agency of Cilegon City, Roya Partial can be done conventionally by coming directly to the Office of the National Land Agency of Cilegon City and can also be done electronically through a website that can be done by banks. . There are several obstacles in the implementation of Roya Partial related to the existence of conflicting regulations. For this reason, the National Land Agency Office of Cilegon City makes efforts by suggesting to the bank as the holder of the Mortgage to seize all new Mortgage Rights by making APHT for some objects of Mortgage Rights that cannot be released from the debtor's debt settlement

Additional Information:	Hapusnya Hak Tanggungan dapat dilakukan dengan cara sebagian atau disebut juga Roya Partial sebagaimana diatur dalam Pasal 2 Undang-Undang Hak Tanggungan. Namun berlakunya Peraturan Menteri Negara Agraria Nomor 3 Tahun 1997 sangat bertentangan dengan ketentuan Roya dan Roya Partial sebagaimana diatur dalam Pasal 2 Undang-Undang Hak Tanggungan. Keadaan ini tentunya menimbulkan permasalahan, karena terdapatnya pengaturan yang berbeda dalam melakukan penghapusan terhadap pembebanan Hak Tanggungan. Dalam Penelitian ini akan dibahas tentang pelaksanaan Roya Partial dalam penjaminan Hak Tanggungan khususnya yang terjadi di Kantor Badan Pertanahan Nasional Kota Cilegon setelah berlakunya Peraturan Menteri Negara Agraria/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 1997 dan kendala-kendala apa saja yang dihadapi Kantor Badan Pertanahan Nasional Kota Cilegon dalam pelaksanaan Roya Partial Hak Tanggungan setelah berlakunya Peraturan Menteri Negara Agraria/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 1997. Penelitian ini menggunakan teori kepastian hukum. Selanjutnya metode penelitian yang digunakan adalah yurisdis normarif, dengan spesifikasi deskriptif analisis, sumber datanya berupa data sekunder yang ditunjang dengan data primer, teknik pengumpulan datanya berupa penelitian kepustakaan dan penelitian lapangan, analisis data dengan analisis kualitatif dan lokasi penelitian di Kantor Badan Pertanahan Nasional Kota Cilegon, Adapun dari penelitian yang Penulis lakukan didapati bahwasanya, Berdasarkan hasil wawancara dengan Kantor Badan Pertanahan Nasional Kota Cilegon, Roya Partial dapat dilakukan dengan cara konvensional dengan datang langsung ke Kantor Badan Pertanahan Nasional Kota Cilegon dan dapat juga secara elektronik melalui website yang dapat dilakukan oleh bank. Terdapat beberapa kendala dalam pelaksanaan Roya Partial terkait dengan adanya ketentuan peraturan yang saling bertentangan satu sama lain. Untuk itu Kantor Badan Pertanahan Nasional Kota Cilegon melakukan upaya-upaya dengan cara menyarankan kepada pihak bank selaku pemegang Hak Tanggungan untuk meroya semua Hak Tanggungan baru dengan membuat APHT terhadap sebagian obyek Hak Tangunggan yang belum bisa di bebaskan dari pelunasan hutang debitor.
