Abstract

Land is a valuable asset that cannot be separated from human activities. Human interests cannot be separated from the use of land as a necessity. This also applies to the government, in carrying out development for the public interest, the need for land is needed as a means of supporting the building that built. However, the facts on the ground are problems often occur regarding compensation for a land acquisition. Identification of the problem in this study is what is the basis for the land owner to object and reject the decision regarding the amount of compensation determined by the public appraisal service office for land acquisition for the Serang Panimbang toll road, and Does the Serang District Court Decision Number 117/Pdt.G/2018/PN. The SRG regarding the amount of compensation has a legal basis in granting the land owner's claim. The theory used in this research is the theory of legal certainty. The data sources used are secondary data sources consisting of primary, secondary and tertiary legal materials, and data collection techniques using library research. The results of the research and discussion of this research are : first, the land owner which refuses the amount of compensation is because the price of land offered by the Public Appraisal Service Office is considered too low and not in accordance with the market price of the surrounding land as well as unlawful acts committed by Appraisal , the procurement committee. land and institutions that require land. Second, that the decision on Civil Case number 117/Pdt.G/2018/PN.SRG is not based on applicable laws and regulations. because according to article 41 paragraph (2) letter a has been implemented or the provision of compensation has been deposited in the district court in accordance with article 42 paragraph (1), it can be concluded that the ownership or rights to land of the party entitled to be deleted and the evidence is declared does not apply so that the land becomes land controlled directly by the state. Since the issuance of the determination of the consignment of compensation from the court. Suggestions in this study are for the land procurement committee team and agencies that require land, it is hoped that they will be more careful in compensation for land acquisition so it doesn’t cause harm to any party. Additional Information: Tanah merupakan aset berharga yang tak bisa dipisahkan dari kegiatan manusia. Kepentingan manusia tidak terlepas dari penggunaan tanah sebagai kebutuhan. Hal tersebut juga berlaku bagi pemerintah, dalam melakukan pembangunan untuk kepentingan umum, kebutuhan akan tanah dibutuhkan sebagai sarana penunjang bangunan yang akan didirikan. Tetapi, pengadaan tanah di lapangan sering terjadi permasalahan mengenai ganti kerugian atas tanah. Identifikasi masalah dalam penelitian ini adalah apakah yang menjadi dasar pemilik tanah keberatan dan menolak putusan mengenai besarnya ganti rugi yang ditetapkan kantor jasa penilai publik pembebasan lahan jalan tol Serang Panimbang, dan Apakah Putusan Pengadilan Negeri Serang Nomor 117/Pdt.G/2018/PN.SRG tentang besaran ganti rugi memiliki dasar hukum dalam mengabulkan permohonan gugatan pemilik Tanah . Teori yang digunakan dalam peneltian ini adalah teori kepastian hukum dan teori keadilan. Sumber data yang digunakan adalah sumber data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier, dan teknik pengumpulan data menggunakan penelitian pustaka. Hasil Penelitian dan pembahasan dari penelitian ini adalah pertama, pemilik tanah yang bersangkutan menolak besaran ganti kerugian dikarenakan harga tanah yang ditawarkan oleh KJPP dinilai terlalu rendah dan juga akibat dari perbuatan melawan hukum yang dilakukan oleh Appraisal, panitia pengadaan tanah dan instasi yang memerlukan tanah. Kedua, bahwa putusan Perkara Perdata nomor 117/Pdt.G/2018/PN.SRG tidak berdasarkan hukum dan peraturan yang berlaku . dikarenakan menurut pasal 41 ayat (2) huruf a telah dilaksanakan atau pemberian ganti kerugian sudah dititipkan di pengadilan negeri sesuai dengan pasal 42 ayat (1), hal tersebut dapat disimpulkan bahwa kepemilikan atau hak atas tanah dari pihak yang berhak menjadi hapus dan alat buktinya dinyatakan tidak berlaku sehingga tanahnya menjadi tanah yang dikuasai langsung oleh negara. Sejak keluarnya penetapan konsinyasi ganti kerugian dari pengadilan. Saran pada penelitian ini adalah untuk tim appraisal agar cermat dalam menilai ganti kerugian para pihak yang berhak. Kedua, untuk tim panitia pengadaan tanah dan instansi yang memerlukan tanah, diharapkan lebih cermat dalam berkoordinasi dan menjalankan perintah sesuai undang – undang
