Abstract
Cosmetics are products used on human skin to cleanse, beautify, enhance attractiveness or change appearance. The use of cosmetics has two influences, namely positive and negative influences. The negative effect of using cosmetics is due to the presence of a mixture of harmful ingredients such as mercury. The Minamata Convention is a global instrument that regulates the global use of mercury, with the aim of protecting human health and the environment. Indonesia ratified the Minamata convention to try to prevent mercury in products, such as cosmetics. Problem Identification is, How is the 2013 Minamata Convention applied in the prohibition of the use of mercury in cosmetic products in Indonesia? What are the obstacles to the implementation of the 2013 Minamata Convention in the prohibition of the use of mercury in cosmetic products in Indonesia? The theory used is the Incorporation Transformation Theory and the Legal Effectiveness Theory. The method is juridical empirical research method, namely library materials. Data collection techniques with literature studies and interviews, the analysis used qualitative analysis. The results of the research, Implementation of the 2013 Minamata Convention on the prohibition of the use of mercury in cosmetic products in Indonesia through Presidential Regulation Number 21 of 2019 concerning the National Action Plan for Mercury Reduction and Elimination for mercury-free cosmetic commitments. Economic barriers, because the economy is the motivation for business actors to include cosmetics to get a lot of profit. Conclusion The implementation of the Minamata Convention on the prohibition of the use of mercury in cosmetic products in Indonesia has been implemented through Presidential Regulation Number 21 of 2019 concerning the National Action Plan for Mercury Reduction and Elimination for mercury-free cosmetic commitments. The obstacle is the economic factor, they do this by making cosmetics with thorns in order to get bigger profits, because original cosmetics are usually reached at much more expensive prices. It is suggested that cooperation is needed to improve the implementation of the Minamata Convention regarding the prohibition of the use of mercury in cosmetic products. Increasing supervision, strengthening law enforcement, and public awareness to be more careful in using cosmetics.

Penggunaan kosmetik terdapat dua pengaruh yaitu pengaruh positif dan negatif. Pengaruh negatif dalam penggunaan kosmetik disebabkan adanya campuran bahan-bahan berbahaya seperti merkuri. Konvensi Minamata ialah instrumen global yang mengatur terkait penggunaan merkuri secara global, memiliki tujuan untuk melindungi kesehatan manusia dan lingkungan hidup, Indonesia meratifikasi konvensi Minamata berupaya mencegah merkuri pada produk-produk, seperti kosmetik. Identifikasi Masalahnya adalah, Bagaimana implementasi Konvensi Minamata 2013 dalam larangan penggunaan merkuri terhadap produk kosmetik di Indonesia? Bagaimana hambatan implementasi Konvensi Minamata 2013 dalam larangan penggunaan merkuri terhadap produk kosmetik di Indonesia? Teori yang digunakan, Teori Transformasi Inkorporasi dan Teori Efektivitas Hukum. Metode yaitu yuridis empiris cara meneliti yaitu bahan kepustakaan. Teknik pengumpulan data dengan studi kepustakaan dan wawancara, analisis yang dipakai analisis kualitatif. Hasil penelitian, Implementasi Konvensi Minamata 2013 dalam larangan penggunaan merkuri terhadap produk kosmetik di Indonesia melaui Peraturan Presiden Nomor 21 Tahun 2019 Tentang Rencana Aksi Nasional Pengurangan dan Penghapusan Merkuri untuk komitmen kosmetik bebas merkuri. Hambatan ekonomi, karena ekonomi menjadi motivasi pelaku usaha dalam memalsukan kosmetik untuk mendapatkan keuntungan yang banyak. Kesimpulan Implementasi Konvensi Minamata dalam larangan penggunaan merkuri terhadap produk kosmetik di Indonesia telah diimplementasikan melalui Peraturan Presiden Nomor 21 Tahun 2019 Tentang Rencana Aksi Nasional Pengurangan dan Penghapusan Merkuri untuk komitmen kosmetik bebas merkuri. Hambatannya yaitu faktor ekonomi mereka melalukan itu dengan cara membuat kosmetik bermerkuri agar dapat keuntungan lebih besar, Sebab kosmetik asli biasanya dijangkau dengan harga yang jauh lebih mahal. Saran diperlukan kerjasama untuk bisa mengoptimalkan implementasi Konvensi Minamata terkait larangan penggunaan merkuri terhadap produk kosmetik. Sebaiknya meningkatkan pengawasan, penguatan penegakan hukum, dan kesadaran masyarakat agar lebih berhati-hati dalam penggunaan kosmetik. | |||||||||
