Abstract
Legal protection is an act of protecting someone whose rights are not fulfilled.Business actors in buying and selling online with the Cash On Delivery (COD) payment method experience that their rights are not fulfilled, namely the right to receive payments in accordance with the agreement regarding the conditions and exchange rates of traded goods and/or services and the right to obtain legal protection from acts consumers with bad intentions, listed in Article 6 of Law Number 8 of 1999 concerning Consumer Protection.Based on the above, the authors need to research further about legal protection for business actors in buying and selling online with the Cash On Delivery (COD) payment method at PT. Shopee Indonesia, as for the formulation of the problem: (1) What is the legal relationship between the parties in buying and selling online with the Cash On Delivery (COD) payment method at PT. Shopee Indonesia? (2) What is the legal protection for business actors in online buying and selling transactions with the Cash On Delivery (COD) payment method? The results of the study show that the legal relationship between the parties in the online sale and purchase of the Cash On Delivery (COD) payment method includes a two sided legal relationship because both parties give and ask for something. Second, the legal protection that business actors get uses legal consequences if they break a promise, namely Article 1266 of the Civil Code concerning cancellation of agreements, thus sending the goods back to business actors and Shopee will deactivate consumer accounts that carry out bad faith when buying and selling online payment methods Cash On Delivery (COD) twice in 60 days, and will be reactivated after 60 days from the date of deactivation, but this has not given a deterrent effect to consumers.

| Additional Information: | Perlindungan hukum adalah perbuatan melindungi seseorang yang hak-hak nya tidak terpenuhi. Pelaku usaha dalam jual beli online dengan metode pembayaran Cash On Delivery (COD) mengalami tidak terpenuhi hak-hak nya yaitu hak menerima pembayaran yang sesuai dengan kesepakatan mengenai kondisidan nilai tukar barang dan/atau jasa yang diperdagangkan dan hak untuk mendapatkan perlindungan hukum dari tindakan konsumen yang beritikad tidak baik, tercantum dalam Pasal 6 Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. Berdasarkan hal di atas, maka penulis perlu untuk meneliti lebih jauh tentang perlindungan hukum terhadap pelaku usaha dalam jual beli online dengan metode pembayaran Cash On Delivery (COD) di PT. Shopee Indonesia, adapun rumusan masalahnya: (1) Bagaimana hubungan hukum antara para pihak dalam jual beli online metode pembayaran Cash On Delivery (COD) di PT. Shopee Indonesia? (2) Bagaimana perlindungan hukum terhadap pelaku usaha dalam transaksi jual beli online metode pembayaran Cash On Delivery (COD)? Hasil penelitian menunjukan bahwa hubungan hukum antara para pihak dalam jual beli online metode pembayaran Cash On Delivery (COD) termasuk hubungan hukum bersegi dua karena kedua belah pihak saling memberikan dan meminta sesuatu. Kedua, secara perlindungan hukum yang didapatkan pelaku usaha menggunakan akibat hukum jika ingkar janji yaitu Pasal 1266 KUH Perdata tentang pembatalan perjanjian, dengan demikian dikirimkannya kembali barang tersebut kepada pelaku usaha serta Shopee akan menonaktifkan akun konsumen yangmelakukan itikad tidak baik saat jual beli online metode pembayaran Cash On Delivery (COD) sebanyak dua kali dalam 60 hari, dan akan diaktifkan kembali setelah 60 hari terhitung dari tanggal dinonaktifkan, namun hal ini belum memberikan efek jera kepada konsumen. | |||||||||
