Abstract

Children have the right to fulfill their right to health, which is the authority of the local government in providing child-friendly health service facilities at the health centers based on the South Tangerang City Regional Regulation Number 1 of 2018 concerning the Implementation of a Child-Friendly City. The identification of the problems, how is the effectiveness of the law on the authority of the local government in providing child-friendly health service facilities at the health centers as a standard for child-friendly cities in South Tangerang City based on South Tangerang City Regional Regulation Number 1 of 2018 concerning the Implementation of Child-Friendly Cities? and what are the government's efforts for child-friendly health services facilities at health centers as a standard for child-friendly cities in South Tangerang City based on its? The theories used are of legal effectiveness theory and the public service theory. The method used in this research is empirical juridical with analytical data through a qualitative approach using primary data -in the form of interviews with the head/leader of the health centers- and secondary data. The results obtained show that the effectiveness of the law is fully implemented in 15 health centers in South Tangerang City, while the rest of 16 health centers have not carried out as the rules should, so the law is declared ineffective, as well as the efforts of the local government in the Regional Action Plan for Child Friendly Cities (RAD-KLA) for distribution of facilities that have not been as competent as health workers with the Convention on the Right to the Top is not yet optimal, to do the counseling rooms are not evenly distributed at the puskesmas. The conclusion is that the effectiveness of the law in South Tangerang City is not fully implemented, and the efforts made by the Regional Government regarding the distribution of child-friendly health service facilities have not been optimal. Suggestions, the South Tangerang City Government should focus more on the implementation of equitable distribution of child-friendly health care facilities in all health centers and information related to children's rights, especially health rights in health centers.

Adapun indentifikasi masalahnya, bagaimana efektivitas hukum atas kewenangan pemerintah daerah dalam penyediaan fasilitas pelayanan kesehatan ramah anak di puskesmas sebagai standar kota layak anak di Kota Tangerang Selatan berdasarkan peraturan daerah Kota Tangerang Selatan Nomor 1 Tahun 2018 tentang Penyelenggaraan Kota Layak Anak? dan, apakah upaya pemerintah daerah dalam penyediaan fasilitas pelayanan kesehatan ramah anak di puskesmas sebagai standar kota layak anak di Kota Tangerang Selatan berdasarkan peraturan daerah Kota Tangerang Selatan Nomor 1 Tahun 2018 tentang Penyelenggaraan Kota Layak Anak? Teori yang digunakan yaitu, teori efektivitas hukum dan teori pelayanan publik. Metode yang digunakan dalam penelitian ini yuridis empiris dengan analitis data melalui pendekatan kualitatif menggunakan data primer -berupa wawancara kepada kepala puskesmas- dan data sekunder. Hasil penelitian yang didapat adalah efektivitas hukum sepenuhnya terlaksana di 15 puskesmas di Kota Tangerang Selatan, selebihnya di 16 puskesmas belum melaksanakan sebagaimana aturan yang seharusnya, sehingga dinyatakan hukumnya tidak efektiv, serta upaya pemerintah daerah dalam Rencana Aksi Daerah Kota Layak Anak (RAD-KLA) untuk pemerataan fasilitas yang belum seperti tenaga kesehatan berkompetensi Konvensi Hak Atas belum optimal, karena belum meratanya ruang konseling di puskesmas. Kesimpulan efektivitas hukumnya di Kota Tangerang Selatan tidak sepenuhnya terlaksanan, upaya yang dilakukan oleh Pemerintah Daerah terkait pemerataan fasiltias pelayanan kesehatan ramah anak belum optimal. Saran, Pemerintah Kota Tangerang Selatan seharusnya lebih fokus kepada pelaksanaan pemerataan fasilitas pelayanan kesehatan ramah anak di semua puskesmas dan informasi terkait hak anak terutama hak kesehatan di puskesmas.
