Abstract

Penelitian ini membahas analisis formulasi kebijakan penetapan Upah Minimum Kota (UMK) di Kota Cilegon dengan memfokuskan diri kepada teori analisis formulasi kebijakan model proses Thomas R. Dye. Para aktor perumus kebijakan UMK Cilegon diwadahi dalam Dewan Pengupahan Kota (Depenko) Cilegon maupun Dewan Pengupahan Provinsi (Depenprov) Banten. Proses penetapan UMK Cilegon yang dimulai dari formulasi hingga terbitnya Kepgub Banten tentang Penetapan UMK di Prov. Banten menemui berbagai kendala diantaranya, perbedaan pandangan dan kepentingan antara serikat pekerja/buruh dengan APINDO terkait penggunaan payung hukum. Apakah tetap menggunakan PP 78 Tahun 2015 tentang Pengupahan atau SE Kemenakertrans RI Nomor: M/11/HK.04/X/2020 tentang Penetapan Upah Minimum Tahun 2021 pada Masa Pandemi Corona Virus Disease 2019 (Covid-19). Penelitian ini menggunakan pendekatan kualitatif, sedangkan teknik pengumpulan data diperoleh melalui pengamatan, wawancara, penelusuran dokumentasi serta pelaksanaan Forum Group Diskusi (FGD). Sementara itu teknik analisis data menggunakan Critical Systemic Thingking guna menemukan keterkaitan pola-pola dalam sebuah fenomena. Dalam proses penggalian informasi pada penelitian kebijakan UMK Cilegon tahun 2021, ditemukan kultur pengusaha yang cenderung selalu berkeinginan membayar upah hanya untuk pemenuhan Kebutuhan Hidup Layak (KHL) bagi pekerja/buruh, sebagai akibat pengaruh lingkungan strategis nasional dan global. Saran penulis terkait hal tersebut, perlu kiranya memasukan kesejahteraan pekerja/buruh dalam rencana strategis nasional pada tataran pemangku kebijakan yang lebih tinggi.

Additional Information: By concentrating on the theory of policy formulation analysis of the Thomas R. Dye process model, this paper discusses the analysis of the policy formulation for calculating the City Minimum Wage (UMK) in Cilegon City. The Cilegon City Wage Council (Depenko) and the Banten Provincial Wage Council (Depenprov) are where the Cilegon MSE policy is formulated. From the formulation to the issuance of the Banten Governor Decree concerning the Determination of the UMK in Prov. Banten, the process of determining the Cilegon UMK encountered a number of roadblocks, including differences in views and interests between trade unions and APINDO regarding the use of the legal umbrella. During the Corona Virus Disease 2019 (Covid-19), will you continue to utilize PP 78 of 2015 concerning wages or SE of the Ministry of Manpower and Transmigration of the Republic of Indonesia Number: M/11/HK.04/X/2020 concerning Minimum Wage Determination in 2021 Period of Pandemi. The data for this study was gathered using a qualitative approach, with observations, interviews, document searches, and the usage of a Discussion Group Forum (FGD) as data gathering tools. Meanwhile, Critical Systemic Thinking is used in the data analysis technique to uncover connections between patterns in a phenomenon. As a result of the influence of the national and global strategic environment on the Cilegon UMK policy research in 2021, it was discovered a culture of entrepreneurs who tend to constantly want to pay salaries solely to fulfill the Decent Living Needs (KHL) for workers/laborers. According to the author's suggestion, the welfare of workers/laborers should be included in the national strategic plan at the level of senior policymakers.
