Abstract
Online marriage is a form of marriage in which the consent transaction is carried out through a network or internet system. So between the groom and the bride, the guardian and the witness do not meet each other and gather in one place, what is shown is only a form of visualization. The Marriage Law and Islamic Law Compilation have not specifically regulated this online marriage, so there are still many differences of opinion regarding whether the marriage is legal or not. The identification of the problems studied in this study are first, How is the Online Marriage Law Review in the Perspective of the Marriage Law and Islamic Law Compilation, second, Can Online Marriage in the Perspective of the Marriage Law and Islamic Law Compilation be considered valid, The theory used is the theory of agreement in Islam and the theory of maslahah mursalah The research method used is the normative juridical method, and the research is descriptive analytical, while the data sources used are primary legal materials, secondary legal materials and tertiary legal materials. Primary obtained through field studies in the form of interviews in accordance with the problems studied so as to find answers. Based on the results of the study, firstly, in the Marriage Law there is no special regulation regarding online marriage as well as in Islamic Law Compilation there is only a legal requirement for a marriage guardian to be in one place which is the understanding of ittihad al-majlis so as long as there is no firmness from law enforcement agencies which opinion is enforced at the Religious Affairs office and the Religious Courts, then the online marriage contract is valid as long as there is no doubt and the marriage agreement meets the pillars and conditions of marriage. Second, the validity of online marriage according to the Marriage Law has fulfilled all the pillars and conditions of marriage and does not conflict with Islamic Law Compilation, then the marriage is considered valid. This is confirmed by the provisions of articles 27 to 29 of the Islamic Law Compilation, and article 2 paragraph (1) articles 6 and 7 of the Marriage Law then all the conditions and pillars of marriage are fulfilled. Additional Information: | Nikah online merupakan suatu bentuk pernikahan yang transaksi ijab kabulnya dilakukan melalui suatu jaringan atau sistem internet. Jadi antara mempelai lelaki dengan mempelai perempuan, wali dan saksi itu tidak saling bertemu dan berkumpul dalam satu tempat, yang ditampilkan hanyalah bentuk visualisasi. UU Perkawinan dan KHI belum mengatur secara khusus mengenai nikah online ini sehingga, pernikahan semacam ini masih banyak perbedaan pendapat mengenai sah atau tidaknya pernikahan tersebut. Adapun identifikasi masalah yang dikaji dalam penelitian ini adalah pertama, Bagaimana Tinjauan Hukum Nikah Online dalam Perspektif UU Perkawinan dan KHI, kedua, Apakah Nikah Online dalam Perspektif UU Perkawinan dan KHI dapat dianggap sah, Teori yang digunakan adalah teori perjanjian dalam islam dan teori maslahah mursalah, metode penelitian yang digunakan adalah metode yuridis normatif, dan penelitian bersifat deskriptif analistis, adapun sumber data yang digunakan adalah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, teknik pengumpulan data dilakukan melalui studi kepustakaan untuk selanjutnya data dianalisis secara deskriptif kualitatif dan data primer yang diperoleh melalui studi lapangan berupa wawancara sesuai dengan masalah yang diteliti sehingga menemukan jawaban. Berdasarkan hasil penelitian, pertama, di dalam UU Perkawinan belum ada pengaturan khusus mengenai pernikahan online begitupun di KHI yang ada hanya syarat sah wali nikah harus dalam satu tempat yang menjadi pemahamaan ittihad al-majlis jadi selama belum ada ketegasan dari lembaga penegak hukum pendapat mana yang diberlakukan di KUA dan Pengadilan Agama, maka pelaksanaan pernikahan secara online akad nikahnya sah selama ijab dan kabul tidak ada keraguan dan memenuhi rukun dan syarat pernikahan. Kedua keabsahan pernikahan secara online menurut UU Perkawinan sudah memenuhi semua rukun dan syarat pernikahan serta tidak bertentangan dengan KHI, maka perkawinan tersebut di anggap sah. Hal ini dikuatkan dengan ketentuan pasal 27 sampai 29 KHI, dan pasal 2 ayat (1) pasal 6 dan 7 UU Perkawinan kemudian semua syarat dan rukun pernikahan terpenuhi. | |||||||||
