Abstract

Civil Servant Investigators are one of the law enforcement officers who have the function to conduct investigations who are given special authority to carry out the investigation process against a violation of the Regional Government Legal Product, namely the Regional Regulation (PERDA) which contains elements regulating that the investigation is a special authority to the Civil Servant Investigator. Civil servants to carry out investigations, in practice the existence of Civil Servant Investigators is often neglected and less effective and it seems that there is a tug of war between two legal officers who should be able to synergize with each other in carrying out their respective authorities in order to create a legal order. Therefore, the authority of PPNS is very much needed for the creation of legal stability. The identification of the problem is how the position and duties of civil servant investigators against Enforcement of Violations of Micro, Small and Medium Enterprises Permits in Cilegon City are based on Regional Regulation Number 8 of 2018 concerning Civil Servant Investigators ( PPNS)? then How are the Efforts to Enforce Micro, Small and Medium Business Permit Violations in Cilegon City by Civil Investigators Based on Cilegon City Regulation Number 8 of 2018 concerning Civil Servant Investigators (PPNS)? . The research method used is empirical juridical with the research specification is descriptive analytical. The results of this study are in the form of enforcement in accordance with applicable rules. Prohibited from operating because it is not in accordance with the principles of licensing, spatial planning as well as Local Wisdom and Religious Norms of the Cilegon City Society, therefore the Cilegon City PPNS makes efforts to seal businesses that violate the rules that have been set. Suggestions to the authority of PPNS are that there must be good commitment and synergy (running synergistically) between the Government and business actors related to violation activities committed by entrepreneurs. Additional Information:	Penyidik Pegawai Negeri Sipil merupakan salah satu aparat penegak hukum yang memiliki fungsi untuk melakukan penyidikan yang diberi wewenang khusus untuk melakukan proses penyidikan terhadap suatu pelanggaran Produk Hukum Pemerintah Daerah yaitu Peraturan Daerah (PERDA) yang mengandung unsur mengatur bahwa penyidikan merupakan wewenang khusus kepada Penyidik Pegawai Negeri Sipil untuk melakukan penyidikan, prakteknya eksistensi Penyidik Pegawai Negeri Sipil ini sering terabaikan dan kurang efektif dan terkesan adanya tarik menarik kewenangan antara dua aparat hukum yang seharusnya dapat saling bersinergi dalam melaksanakan kewenangannya masing-masing agar tercipta suatu ketertiban hukum. Oleh karna itu kewenangan PPNS sangat di perlukan untuk terciptanya kestabilan hukum.Adapun identifikasi masalahnya adalah Bagaimana kedudukan dan tugas penyidik pegawai negeri sipil terhadap Penegakan Pelanggaran Izin Usaha Mikro Kecil dan Menengah di Kota cilegon berdasarkan Peraturan Daerah Nomor 8 Tahun 2018 tentang Penyidik Pegawai Negeri Sipil (PPNS)? kemudian Bagaimana Upaya Penegakan Pelanggaran Izin Usaha Mikro Kecil dan Menengah di Kota Cilegon oleh Pegawai Penyidik Negeri Sipil Berdasarkan Peraturan Daerah Kota Cilegon Nomor 8 Tahun 2018 tentang Penyidik Pegawai Negeri Sipil (PPNS) ?, adapun teori yang di gunakan yaitu teori kewenangan dan teori penegakan hukum. Metode penelitian yang digunakan adalah yuridis empiris dengan spesifikasi penelitiannya adalah deskriptif analitis. Hasil penelitian ini berupa penegakan penegakan sesuai dengan aturan yang berlaku.Kesimpulan nya yaitu PPNS merupakan penyidik disamping penyidik Polri yang memiliki kedudukan serta berperan penting dalam melakukan penyidikan, dalam kaitannya menegakkan hukum di Indonesia,Pemerintah Kota Cilegon menyatakan bahwa Usaha Hiburan Malam di Kota Cilegon, Dinyatakan Dilarang Beroperasi karena tidak sesuai dengan prinsip perizinan, tata ruang serta Kearifan Lokal dan Norma Agama Masyarakat Kota Cilegon maka dari itu PPNS kota Cilegon melakukan upaya penyegelan terhadap usaha yang melanggar perarturan yang sudah di tetapkan. Saran terhadap kewenangan PPNS yaitu harus Adanya komitmen serta sinergitas (berjalan sinergis) yang baik antara Pemerintah dengan Pelaku usaha terkait dengan aktivitas pelanggaran yang dilakukan oleh pengusaha.
