Abstract
Pertanggungjawaban pidana adalah kemampuan untuk mempertanggung jawabkan sebab & akibat dari perbuatan sendiri. pembunuhan dan kecelakaan, mengandung dua dimensi dan dua anasir pidana yang berbeda. Identifikasi masalah di dalam penelitian ini, yaitu: Pertama, Bagaimana pertanggungjawaban pidana tindak pidana lalu lintas yang mengakibatkan orang lain meninggal dalam putusan Nomor 315/Pid.B/2018/PN.Skt?; Kedua, Apa yang menjadi pertimbangan hukum hakim (Ratio decidendi) mengabaikan dakwaan menghilangkan nyawa orang lain dan penganiayaan yang menyebabkan kematian dalam Putusan Nomor 315/Pid.B/2018/PN.Skt? Penelitian yang dilakukan adalah tipe penelitian yuridis normative dengan pendekatan perundang-undangan dan pendekatan kasus. Penelitian ini menggunakan data sekunder yang digunakan terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian diperoleh simpulan bahwa: Pertama, Pertanggungjawaban pidana tindak pidana lalu lintas yang mengakibatkan orang lain meninggal dapat dikenai pertanggungjawaban pidana Pasal 310 ayat (4) karena kelalaian dan Pasal 311 ayat (5) karena kesengajaan. Kedua, Ditemukan corak kesengajaan sebagai kemungkinan menabrak motor dengan mobil tidak pasti mati, bisa saja luka ringan, luka berat dan yang fatal mengakibatkan kematian

| Additional Information: | Criminal Liability is the ability to take responsibility for the cause & effect of one's own actions. murder and accident, contain two dimensions and two different elements of crime. Identification of problems in this research, that is: First, how is the responsibility for traffic crimes that resulted in other people dying in Case study: Decision 315/Pid.B/2018/PN.Skt?; Second, how is the ratio dicedendi the judge ignored the charges of losing the life of another person and torture resulting in the death of the person in Case study: Decision 315/Pid.B/2018/PN.Skt? This research is a normative juridical research with a statutory approach and a case approach. This study uses secondary data used consisting of primary legal materials, secondary legal materials and tertiary legal materials. From the research results, it is concluded that: First, Liability for traffic crimes which result in other people dying can be subject to criminal liability in Article 310 paragraph (4) due to negligence and Article 311 paragraph (5) due to deliberate action. Second, it was found intentionally as the possibility of hitting a motorbike with a car that did not necessarily die, it could be minor injuries, serious injuries and fatal ones resulting in death. | |||||||||
