Abstract
ABSTRACT NABILAH FITROH FARAHDITYA 1111160881 Land problems are increasingly complex and increase in quality and quantity, so serious and systematic handling is required. Various efforts to resolve land disputes through the existing litigation (judicial) process are deemed incapable of resolving existing disputes, so that various alternative efforts to resolve land disputes outside the court (non-litigation) such as through mediation, facilitation and others have surfaced with the aim of minimizing disputes. land that is full of interests, both for development and for the community itself, as in the case of the holder of the Sale and Purchase Deed (AJB) Number 84 of 2011 a / n Miduk Marbun covering an area of 605 M2 and holders of Certificate of Ownership (SHM) a / n Ngaliman Letter No Measure 792 / Gerem / 2007. Based on this problem, the researcher examines the application of mediation as an alternative to dispute resolution between the sale and purchase certificate holder (AJB) and the holder of the title of ownership (SHM) at the Cilegon City National Land Office based on the Agrarian Regulation No.11 of 2016. juridical normative by using secondary data as the main data and using the statute approach (statue approach). As for the results of this research, it is realized that BPN is not a dispute resolution institution, so the results of the mediation set forth in the Peace Agreement do not have binding legal force, so there is a concern that if one party denies the agreement set forth in the Peace Agreement, the problem will not be resolved. Mediation does not regulate how and what the peace deed will look like, so the process of execution of the peace deed refers to the terms of execution for court decisions in general, because the peace deed is a legal document whose position is aligned with a judge's decision which has permanent legal force.

Additional Information: | Masalah pertanahan semakin kompleks dan meningkat secara kualitas maupun kuantitas, maka diperlukan penanganan secara serius dan sistematis. Berbagai upaya penyelesaian sengketa pertanahan melalui proses litigasi (peradilan) yang ada dianggap belum mampu menyelesaikan sengketa yang ada, sehingga berbagai upaya alternatif penyelesaian sengketa pertanahan di luar pengadilan (Non-Ligitasi) seperti melalui mediasi, fasilitasi dan lainnya kemudian mengemuka dengan sasaran untuk meminimalisir sengketa pertanahan yang sarat dengan kepentingan, baik untuk kepentingan pembangunan maupun masyarakat sendiri seperti halnya dalam kasus pemegang Akta Jual Beli (AJB) Nomor 84 Tahun 2011 a/n Miduk Marbun seluas 605 M2 dan pemegang Sertifikat Hak Milik (SHM) a/n Ngaliman No Surat Ukur 792/Gerem/2007. Berdasarkan permasalahan tersebut peneliti mengkaji mengenai Penerapan mediasi sebagai alternatif penyelesaian sengketa antara pemegang akta jual beli (AJB) dan pemegang sertifikat hak milik (SHM) di Kantor Pertanahan Nasional Kota Cilegon berdasarkan Permen Agraria No.11 Tahun 2016 Dalam penelitian ini peneliti menggunakan jenis penelitian Hukum yuridis normtif dengan menggunakan data sekunder sebagai data utama serta menggunakan pendekataan undang – undang (statue approach). Adapun hasil dari penelitian ini adalah Disadari bahwa BPN bukan lembaga penyelesaian sengketa, maka hasil mediasi yag dituangkan dalam Perjanjian Perdamaian tidak mempunyai kekuatan hukum mengikat, sehingga ada kekhawatiran jika terjadi pengingkaran oleh salah satu pihak terhadap kesepakatan yang dituangkan dalam Perjanjian Perdamaian, permasalahan tidak selesai. Mediasi tidak mengatur tentang bagaimana dan seperti apa akta perdamaian itu dilaksanakan, sehingga proses eksekusi terhadap akta perdamaian mengacu pada ketentuan eksekusi bagi putusan pengadilan pada umumnya, karena akta perdamaian merupakan dokumen hukum yang kedudukannya disejajarkan dengan putusan hakim yang telah berkekuatan hukum tetap.
