Abstract
Kartel merupakan salah satu bentuk strategi persaingan usaha untuk menguasai pasar. Kondisi tersebut pada akhirnya menciptakan persaingan yang ketat antar pelaku usaha dan diharapkan dapat tercipta efesiensi dalam melakukan kegiatan usaha serta mendorong suatu kondisi persaingan yang sehat dan wajar, sehingga tidak menimbulkan adanya pemusatan kekuatan ekonomi pada pelaku usaha tertentu. Kondisi tersebut sering didapati dalam tindakan kartel yang dilakukan oleh pelaku usaha. Tujuan penelitian ini adalah; (1) untuk mengetahui dan mengkaji kerugian yang ditimbulkan akibat kartel yamaha dan honda atas produk motor matic 110-125 CC; (2) pendekatan teori monopoli yang dapat diterapkan oleh Komisi Pengawas Persaingan Usaha; (3) serta mencari solusi agar kartel tidak merugikan masyarakat selaku konsumen. Penelitian ini menggunakan metode penelitian Deskriftif-Analitis. Dari hasil penelitian disimpulkan bahwa; (1) kerugian yang timbul akibat kartel yamaha dan honda atas produk motor matic 110-125 CC yaitu inefesiensi alokasi, inefesiensi produk, menciptakan Barrier to Entry, perekonomian suatu negara tidak kondusif dan kurang kompetitif, sedangkan kerugian terhadap konsumen yaitu harga menjadi tidak wajar serta terbatasnya barang dan jasa, harga yang efisien dan wajar yaitu berada di posisi Rp. 12.000.000 s.d Rp. 14.000.000; (2) pendekatan yang dapat diterapkan terhadap kartel yamaha dan honda berdasarkan ketentuan Pasal 11 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli Dan Persaingan Usaha Tidak Sehat yaitu Rule of Reason. Pendekatan tersebut mengidentifikasi kartel atas produk motor matic 110-125 CC melalui monitoring kegiatan pelaku usaha, analisis secara ekonomi, dan analisis terhadap perjanjian; (3) solusi yang dapat dilakukan oleh Komisi Pengawas Persaingan Usaha agar kartel yamaha dan honda tidak merugikan masyarakat yaitu melakukan inisiasi terhadap pelaku usaha dengan cara pendekatan perilaku (behavior conduct) dan struktur pasar (market structure). Selain itu, dilakukan penerapan leniency program terhadap perkara pesaingan usaha tidak sehat yang telah dibuktikan di banyak negara dan terbukti efisien dalam mengungkap perkara kartel.

Additional Information: | Cartel is a form of business competition strategy to dominate the market. This condition ultimately creates tight competition between business actors and is expected to create efficiency in conducting business activities and encourage a condition of fair and fair competition, so as not to cause a concentration of economic power in certain business actors. This condition is often found in cartel actions carried out by business actors. The objectives of this research are; (1) to find out and examine the losses caused by the yamaha and honda cartels on 110-125 CC automatic motorcycle products; (2) a monopoly theory approach that can be applied by the Business Competition Supervisory Commission; (3) and find solutions so that the cartel does not harm the public as consumers. This research uses descriptive-analytical research method. From the results of the study concluded that; (1) losses arising from the yamaha and honda cartels on 110-125 CC automatic motorcycle products, namely allocation inefficiency, product inefficiency, creating a barrier to entry, the economy of a country is not conducive and less competitive, while losses to consumers are the price becomes unreasonable and limited goods and services, efficient and reasonable price which is in the position of Rp. 12,000,000 to Rp. 14,000,000; (2) the approach that can be applied to the yamaha and honda cartels is based on the provisions of Article 11 of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition, namely the Rule of Reason. This approach identifies cartels for 110125 CC automatic motorcycle products through monitoring the activities of business actors, economic analysis, and analysis of agreements; (3) the solution that can be taken by the Business Competition Supervisory Commission so that the yamaha and honda cartels do not harm the community is to initiate business actors with a behavioral approach (behavior conduct) and market structure (market structure). In addition, the implementation of a leniency program for cases of unfair business competition has been proven in many countries and has proven efficient in uncovering cartel cases. | |||||||||
