Abstract

Pandemi Covid-19 ini memberikan ancaman bagi para pelaku UMKM, terlihat dari penurunan omset sampai tidak ada pemasukan dan menyebabkan gulung tikar diakibatkan oleh kebijakan PSBB. Kebijakan pemerintah dalam menghadapi dampak ekonomi pada masa pandemi covid-19, pemerintah memberikan prioritas dukungan terhadap UMKM dengan alokasi anggaran yang besar. Oleh karena itu penelitian ini akan membahas tentang Bagaimana aspek hukum pendanaan pelaku usaha mikro, kecil, dan menengah sebagai bantuan modal kerja pada masa pandemi covid-19 di Kota Tangerang berdasarkan Peraturan Menteri Koperasi, Usaha Kecil dan Menengah Nomor 6 Tahun 2020?, Apa dampak dari pemberlakuan bantuan modal usaha mikro, kecil dan menengah (UMKM) di wilayah Kota Tangerang terhadap keberlangsungan UMKM?. Kerangka Pemikiran yang penulis gunakan ialah Teori Tindakan Pemerintahan dan Kesejahteraan terhadap pendanaan pelaku usaha mikro, kecil dan menengah (UMKM) sebagai bantuan modal kerja pada masa pandemi COVID-19. Metode penelitian yang penulis pergunakan dalam penyusunan penulisan hukum ini adalah penelitian yuridis empiris, yaitu penelitian yang melihat hukum sebagai kaidah di masyarakat untuk ditaati, dengan spesifikasi deskriptif analitis yang membahas tentang bantuan modal kerja pada masa pandemi covid-19 di Kota Tangerang yang bersumber pada data primer yaitu perundang-undangan, buku, jurnal ilmu hukum, serta bahan kepustakaan lainnya yang dianalisis secara kualitatif. Hasil penelitian ini, bahwa Pemerintah melakukan kebijakan melalui Program Bantuan Langsung bagi UMKM dengan tujuan untuk memperkuat bisnis UMKM. Keberadaan bantuan modal UMKM tersebut berdampak positif terhadap perekonomian dalam masyarakat, sehingga berpengaruh terhadap peningkatan kesempatan kerja. Berdasarkan pembahasan tersebut, maka dapat disimpulkan BPUM diberikan kepada pelaku Usaha Mikro untuk menjalankan usahanya di tengah krisis akibat pandemi COVID-19 dalam rangka program PEN. Dengan adanya kebijakan yang sudah dibuat oleh Kementerian Koperasi dan UKM dalam rangka program PEN harus dimanfaatkan dengan baik oleh pelaku UMKM.

Additional Information:	This Covid-19 pandemic poses a threat to UMKM actors, as seen from the decline in turnover to no income and causing bankruptcy due to the PSBB policy. Government policies in dealing with the economic impact during the COVID-19 pandemic, the government gives priority to support for UMKM with large budget allocations. Therefore, this study will discuss the legal aspects of funding micro, small and medium enterprises as working capital assistance during the COVID19 pandemic in Tangerang City based on the Regulation of the Minister of Cooperatives, Small and Medium Enterprises Number 6 of 2020? from the implementation of micro, small and medium enterprises (UMKM) capital assistance in the Tangerang City area to the sustainability of UMKM?. The Thinking Framework that the author uses is the Theory of Government Action and Welfare for funding micro, small and medium enterprises (UMKM) as working capital assistance during the COVID-19 pandemic. The research method that the author uses in preparing this legal writing is empirical juridical research, namely research that sees the law as a rule in society to be obeyed, with analytical descriptive specifications that discuss working capital assistance during the covid-19 pandemic in Tangerang City which is sourced from data. The primary sources are legislation, books, legal science journals, and other library materials which were analyzed qualitatively. The results of this study, that the Government carried out policies through the Direct Assistance Program for UMKM with the aim of strengthening UMKM businesses. The existence of UMKM capital assistance has a positive impact on the economy in the community, thereby increasing job opportunities. Based on the discussion, it can be concluded that BPUM is given to Micro Business actors to run their business in the midst of the crisis due to the COVID-19 pandemic in the context of the PEN program. With the policies that have been made by the Ministry of Cooperatives and UKM in the context of the PEN program, UMKM actors must use them properly.
