Abstract

Perusahaan di Kota Cilegon masih ditemukan melakukan pelanggaran dalam penggunaan Tenaga Kerja Asing (TKA) terkait kelengkapan perizinan, seperti RPTKA, IMTA, VITAS dan ITAS sebagai dampak dari kurang optimalnya pengawasan TKA di Kota Cilegon oleh instansi terkait. Teori pengawasan menggunakan teori Pandoyo (2014:109) mencakup aspek: (1) ukuran atau standar, (2) mengadakan penilaian, (3) membandingkan pelaksanaan dengan standar, (4) mengadakan perbaikan. Metode penelitian menggunakan deskriptif kualitatif. Informan penelitian meliputi Dinas Tenaga Kerja dan Transmigrasi Provinsi Banten, UPTD Pengawasan Ketenagakerjaan Kota Serang dan Kota Cilegon, Perusahaan di Kota Cilegon, Sponsor TKA dan TKA. Uji keabsahan data menggunakan teknik triangulasi sumber dan membercheck. Analisis data menggunakan analisis data kualitatif Miles dan Huberman. Hasil penelitian diketahui pengawasan TKA yang dilaksanakan oleh Dinas Tenaga Kerja dan Transmigrasi Provinsi Banten pada perusahaan di Kota Cilegon belum optimal karena masih ditemukan masalah yang diantaranya: (1) pelanggaran perusahaan terkait RPTKA dan IMTA yang tidak diurus izinnya dan didominasi IMTA yang belum diperpanjang, (2) pelanggaran tenaga kerja yang legal dalam keimigrasian terkait keterlambatan perpanjangan VITAS dan ITAS, (3) perusahaan menggunakan WNA dengan visa wisatawan untuk bekerja sebagai TKA ilegal. Saran penelitian adalah menambah waktu pengawasan minimal 2-3 kali pada setiap tahunnya, menerapkan sanksi tegas bagi yang melanggar dan sebagainya.

Additional Information: Companies in Cilegon City are still found to have violated the use of Foreign Workers (TKA) related to completeness of permits, such as RPTKA, IMTA, VITAS and ITAS as a result of the less than optimal supervision of foreign workers in Cilegon City by the relevant agencies. Supervision theory using Pandoyo's theory (2014: 109) includes aspects: (1) size or standard, (2) conducting an assessment, (3) comparing implementation with standards, (4) making improvements. The research method uses descriptive qualitative. Research informants include the Manpower and Transmigration Office of Banten Province, UPTD for Labor Supervision in Serang City and Cilegon City, Companies in Cilegon City, Sponsors of Foreign Workers and Foreign Workers. Test the validity of the data using source triangulation and membercheck techniques. Data analysis uses Miles and Huberman qualitative data analysis. The results of the study revealed that the supervision of foreign workers carried out by the Office of Manpower and Transmigration of Banten Province at companies in Cilegon City was not optimal because there were still problems which included: (1) company violations related to RPTKA and IMTA whose permits were not taken care of and dominated by IMTA which had not been extended, ( 2) legal labor violations in immigration related to delays in extending VITAS and ITAS, (3) companies using foreigners with tourist visas to work as illegal foreign workers. Research suggestions are to increase supervision time at least 23 times each year, apply strict sanctions for those who violate and so on
