Abstract
The World Health Organization (WHO) in 2017 noted that the failure rate for contraceptives in Indonesia with the long-term contraceptive method (MKJP) was 8.5 people/1000 for IUD and 0.5%/1000 people from implants. The result is that the community is the user of the use of services to related parties in the settlement. Informed consent contained in the medical action approval sheet (PTM) is one of the solutions. The government's efforts to provide compensation have been made, but legally the existing regulations have not been able to protect the rights of those who feel aggrieved. The purpose of the study was to find out and obtain information related to cases of contraceptive failure, to analyze the legal protection of the rights of family planning participants in Informed consent, and to supervise local governments and their implementation. The research is normative-empirical in nature, the focus of the study is legal norms and the application of law in society, namely processing and analyzing secondary data (regulatory literature, books, journals and sources from the internet), inductively. The research location is in the district and city of Serang - Banten Province. As a result, legal protection against the failure of contraceptive services with the rights of family planning participants to be accepted is not sufficiently clear and firmly stated in Law Number 52 of 2009 and the Regional Government Law, and implementing regulations governing compensation are not integrated and published in permit information. | Additional Information: | Data Badan Kesehatan Dunia (WHO) pada tahun 2017 mencatat bahwa tingkat kegagalan pada alat kontrasepsi di Indonesia dengan metode kontrasepsi jangka panjang (MKJP) sebanyak 8,5 Orang/1000 untuk IUD dan 0,5 %/1000 Orang dari Implant. Akibat yang ditimbulkan adalah ketidakpuasan masyarakat pengguna layanan kontrasepsi terhadap tanggungjawab pihak terkait dalam penyelesaian kasusnya, fungsi Informed consent yang tertuang dalam lembar formulir persetujuan tindakan medik (PTM) merupakan salahsatu faktornya. Upaya Pemerintah memberikan konpensasi telah dilakukan, namun secara hukum regulasi yang ada belum mampu melindungi hak - hak dari pihak yang merasa dirugikan. Tujuan penelitian, mengetahui dan mendapatkan informasi terkait kasus kegagalan kontrasepsi, menganalisis perlindungan Hukum hak peserta Keluarga Berencana dalam Informed consent, dan menganalisis tanggungjawab Pemerintah Daerah serta implementasinya. Penelitian bersifat normatif-empiris, yang menjadi fokus kajian adalah norma hukum dan penerapan hukum dalam masyarakat, yaitu mengolah dan menganalisis data-data sekunder (literatur Perundang-undangan, buku, jurnal dan sumber dari internet), secara induktif. Lokasi penelitian di kabupaten dan kota Serang - Provinsi Banten. Hasil nya, perlindungan hukum terhadap kegagalan pelayanan kontrasepsi berkenaan dengan hak - hak peserta KB yang akan diterima tidak cukup jelas dan tegas tertuang di UU Nomor 52 Tahun 2009 maupun Undang - Undang Pemerinthan Daerah, dan peraturan pelaksana yang mengatur konpensasi tidak terintegrasi dan terpublikasi dalam Informed consent .
