Abstract
One of the principles of village governance as regulated in Article 24 of Law Number 6 of 2014 concerning Villages is the Participatory Principle, namely the involvement of the community in the administration of village governance, including community involvement in the formation of Village Regulations. So that the authors identify the problems, namely: first, what is the role of the village consultative body in the village of Cisaat, Padarincang District, Serang Regency in terms of Law Number 6 of 2014 concerning Villages? second, how are the problems faced by the village consultative body in the process of establishing village regulations in Cisaat Village, Padarincang District, Serang Regency? The theory used in this research is the theory of law formation and the theory of authority. The research method used is an empirical juridical legal research method that is descriptive in nature to obtain a general and comprehensive picture of the actual situation. The data collection techniques used are library and field methods to obtain accurate data. The results showed that the Village Consultative Body in Cisaat Village, Padarincang District, Serang Regency had a role, namely playing a role in discussing and agreeing on village regulations and playing a role in the process of determining the Draft Village Regulation. The role of the Village Consultative Body in determining Village Regulations in Cisaat Village has not been optimal due to several problems such as the lack of good communication and coordination between the Village Government and the Village Consultative Body and the lack of commitment in establishing a draft village regulation. The Village Consultative Body should evaluate the causes of the less than optimal role of the BPD and must improve coordination so that the roles and functions in determining village regulations can run well.

| Additional Information: | Salah satu asas penyelenggaraan pemerintahan desa yang diatur dalam Pasal 24 Undang-Undang Nomor 6 Tahun 2014 Tentang Desa adalah Asas Partisipatif, yakni adanya keterlibatan masyarakat dalam penyelenggaraan pemerintahan desa diantaranya adalah keterlibatan masyarakat dalam pembentukan Peraturan Desa. Sehingga penulis mengidentifikasi masalah yaitu: pertama, bagaimana peran badan permusyawaratan desa di desa Cisaat Kecamatan Padarincang Kabupaten Serang ditinjau dari Undang-Undang Nomor 6 Tahun 2014 Tentang Desa? kedua, bagaimana permasalahan yang dihadapi oleh badan permusyawaratan desa dalam, proses penetapan peraturan desa di Desa Cisaat Kecamatan Padarincang Kabupaten Serang? Teori yang digunakan dalam penelitian ini adalah teori pembentukan undang-undang dan teori kewenangan. Metode penelitian yang digunakan adalah metode penelitian hukum yuridis empiris yang bersifat deskriptif untuk memperoleh gambaran secara umum dan menyeluruh tentang keadaan sebenarnya. Adapun teknik pengumpulan data yang digunakan adalah metode kepustakaan dan lapangan untuk memperoleh data yang akurat. Hasil penelitian menunjukkan bahwa Badan Permusyawaratan Desa di Desa Cisaat, Kecamatan Padarincang, Kabupaten Serang memiliki peran yaitu berperan dalam membahas dan menyepakati peraturan desa dan berperan dalam proses penetapan Rancangan Peraturan Desa. Peranan Badan Permusyawaratan Desa dalam penetapan Peraturan Desa di Desa Cisaat belum optimal disebabkan oleh beberapa permasalahan seperti kurangnya komunikasi dan koordinasi yang baik antara Pemerintah Desa dengan Badan Permusyawaratan Desa serta kurangnya komitmen dalam menetapkan suatu rancangan peraturan desa. Badan Permusyawaratan Desa hendaknya melakukan evaluasi dan atas penyebab kurang maksimalnya peran BPD serta harus meningkatkan koordinasi agar peran dan fungsi dalam penetapan peraturan desa dapat berjalan dengan baik. | |||||||||
