Abstract

The Principle of Full Protection and Security (FPS) in international investment law is an absolute principle of conversion. The Full Principle of Protection and Security has been widely included in various bilateral, regional and multilateral agreements. Indonesia, which has participated in ratifying the ASEAN Comprehensive Investment Agreement (ACIA) into Presidential Regulation No. 49 of 2011 concerning the ASEAN Comprehensive Investment Agreement on August 8, 2011. The research was conducted at two points, namely: first, how the application of the Full Protection and Security Principles in the ASEAN Comprehensive Investment Agreement and; secondly, how sanctions against the Indonesian state that apply the Principle of Full Protection and Security in the agreement of the ASEAN Comprehensive Investment Agreement from PT Freeport sues the state for riots and destruction of property owned by PT Freeport Indonesia. The type of research used is the normative legal research method (normative juridical). The approach in this research is the statute approach and the research of legal principles that are carried out on legal rules. This study uses secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials with library research techniques. Analysis of research data using juridical qualitative analysis. The results of this study, based on Article 11 paragraph (b) of the ACIA Indonesia Agreement as Host States, must provide full protection to investments owned by PT. Freeport in Papua and PT. Freeport can sue the State of Indonesia for the occurrence of riots and property destruction that occurred in Papua, it can submit claims to the ICSID and sanctions received in accordance with court decisions can be in the form of fines / compensation. Additional Information: Prinsip Full Protection and Security (FPS) dalam hukum investasi internasional merupakan prinsip perlindungan yang absolut. Prinsip Full Protection and security telah secara luas dimasukkan di dalam hampir perjanjian bilateral, regional dan multilateral. Indonesia yang telah turut serta meratifikasi ASEAN Comprehensive Investment Agreement (ACIA) ke dalam Peraturan Presiden No. 49 Tahun 2011 tentang Persetujuan Penanaman Modal Menyeluruh ASEAN pada tanggal 8 Agustus 2011. Penelitian ini berfokus pada dua permasalahan, yaitu: pertama, bagaimana penerapan prinsip Full Protection and Security dalam perjanjian ASEAN Comprehensive Investment Agreement dan; kedua, bagaimana sanksi terhadap negara Indonesia yang menerapkan Prinsip Full Protection and Security dalam perjanjian ASEAN Comprehensive Investment Agreement apabila pihak PT Freeport menggugat negara Indonesia atas kerusuhan dan pengrusakan property milik PT Freeport Indonesia Jenis penelitian yang digunakan adalah metode penelitian hukum normatif (yuridis normatif). Pendekatan dalam penelitian ini ialah pendekatan perundang- undangan (statute approach) dan penelitian asas-asas hukum yang dilakukan terhadap kaidah-kaidah hukum. Penelitian ini menggunakan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier dengan teknik pengumpulan data telaah pustaka (library research). Analisis data penelitian menggunakan analisis kualitatif yuridis. Adapun hasil penelitian ini, berdasarkan Pasal 11 ayat (b) Perjanjian ACIA Indonesia sebagai Host States harus memberikan perlindungan penuh kepada investasi yang dimiliki oleh PT. Freeport di Papua dan PT. Freeport dapat menuntut Negara Indonesia atas kejadian kerusuhan dan pengrusakan properti yang terjadi di Papua, pihaknya bisa mengajukan tuntutan ke ICSID dan sanksi yang di terima sesuai dengan putusan pengadilan yang bisa berupa denda/ganti rugi.
