Abstract
The Consideration that underlies this research is, there’s a problem that occurred in this land registration process, that actually aims to provide legal protection and legal certainty to the landowners as the main subject of this complete systematic land registration program. In this case, the problem refers to the legal consequences that occurs after the land certification through the PTSL program itself, it is due to the discrepancy between Government Regulation No. 24 of 1997 about “Land Registration” with The Minister of Agrarian and Spatial Planning or National Land Affairs Department Regulation No. 6 of 2018 about “Complete Systematic of Land Registration Program”. Government Regulation No. 24 of 1997 about land registration explains that the publicity principle announced within 30 days, while the Minister of Agrarian and Spatial Planning or National Land Affairs Department Regulation Number 6 of 2018 about complete systematic land registration program will be announced within 14 days. Things like this probably allow legal defects in certification or land registration through the PTSL program. This Research is a normative – empirical legal research, with a qualitative form that using secondary data consisting of primary legal materials, such as doctrines of laws, and legal regulations, using the historical legal approach method, to analyze the legal basis and the implementation of the legal regulations and the synchronization legal approach to give consistency and synchronization of legal norms, legal subjects and legal objects. The techniques of the data collection are by library research then followed by interviews (if needed). Keywords: Land Registration, Legal Protection and Legal Certainty

| Additional Information: | Pertimbangan yang mendasari dilaksanakannya penelitian ini adalah adanya permasalahan yang muncul dalam proses pendaftaran tanah yang bertujuan memberikan perlindungan hukum dan kepastian hukum pada masyarakat pemilik tanah yang menjadi subyek utama pendaftaran tanah sistematis lengkap. Dalam hal ini, permasalahan yang dimaksud menuju kepada akibat hukum yang akan terjadi setelah sertifikasi tanah melalui program Pendaftaran Tanah Sistematis Lengkap, karena terdapat ketidak sesuaian antara Peraturan Pemerintah Nomor 24 tahun 1997 tentang Pendaftaran Tanah dengan Peraturan Menteri Agraria dan Tata Ruang/ Badan Pertanahan Nasional Nomor 6 tahun 2018 tentang Pendaftaran tanah sistematis lengkap, diantaranya mengenai proses publisitas dan pembuktian haknya, Peraturan Pemerintah Nomor 24 tahun 1997 tentang pendaftaran tanah menjelaskan mengenai asas publisitas diumumkan selama 30 hari, sedangkan dalam Peraturan Menteri Agraria dan Tata Ruang/ Badan Pertanahan Nasional Nomor 6 tahun 2018 tentang Pendaftaran tanah sistematis lengkap diumumkan selama 14 hari, hal-hal seperti ini yang memungkinan terjadinya cacat hukum dalam sertifikasi/ pendaftaran tanah melalui program Pendaftaran Tanah Sistematis Lengkap. Penelitian ini adalah penelitian hukum normative -empiris, bentuk kualitatif dengan menggunakan data sekunder terdiri dari bahan hukum primer, seperti doktrin- doktrin hukum dan peraturan perundangan, menggunakan metode pendekatan hukum historis, untuk menganalisis dasar hukum dan penerapan peraturan perundangan dan pendekatan hukum sinkronisasi untuk memberi konsistensi dan sinkronisasi norma hukum, subyek hukum dan obyek hukum. Teknik pengumpulan data yaitu dengan penelitian kepustakaan (Library Research) kemudian dilanjutkan dengan wawancara (apabila diperlukan).
