Abstract
ABSTRACT EXISTENCE INTERNATIONAL COMMITTEE OF THE RED CROSS (ICRC) IN ARMED CONFLICT ACCORDING TO THE ICRC STATUTE AKBAR RIZKI 1111131024 ICRC in humanitarian organization that neutral, impartial and independent, ICRC has a mandate to assist victims of conflict and other violence contained in the ICRC Statute and the Geneva Conventions. The existence of the ICRC in a conflict is very important because the ICRC is an international organization capable of assisting with independent statuts, the assistance of the ICRC, Protection, Assistance, and Prevention of the three programs must be implemented by the ICRC in a state of armed conflict, the role of the ICRC is not detached from obstacles In the distribution of aid, as for the many constraints that occur is the process of negotiation to the parties in conflict. As for the problems in this study, First is the existence of the International Committee of the Red Cross (ICRC) as a humanitarian institution consistent in providing assistance to victims of armed conflict and Second whether the obstacles of the International Committee of the Red Cross (ICRC) in providing humanitarian assistance to the armed conflict In Syria. This study includes the type of normative juridical research, which viewed from its nature is descriptive. The type of data used is secondary data covering primary legal materials, secondary legal materials, and tertiary legal materials and primary data in the form of structured interviews. Data collection techniques used, namely literature study. The results of this study show that, first relating to the existence and consistency of the ICRC in an armed conflict according to the ICRC Statute that the ICRC is an organization that provides humanitarian assistance in all armed conflicts in the world, that at present the ICRC continues to provide its assistance in the conflicts of Syria seen from the increase in aid every year. Second, the obstacles that occur more involving the state, the state does not understand the importance of the Statute of the ICRC and the Geneva Convention IV, consequently the ICRC has difficulty reaching the most affected victims. Eksistensi ICRC dalam sebuah konflik sangat penting karena ICRC adalah organisasi internasional yang mampu melakukan bantuan dengan statutsnya yang independen, bantuan yang dilakukan oleh ICRC yaitu Protection, Assistance, and Prevention ketiga progam tersebut harus dijalankan ICRC dalam keadaan konflik bersenjata, Peran ICRC tidak lepas dari hambatan dalam pendistribusian bantuan, adapun kendala yang banyak terjadi adalah proses negosisasi kepada para pihak yang berkonflik. Adapun yang dijadi permasalahan dalam penelitian ini adalah, Pertama Apakah Eksistensi International Committee of The Red Cross (ICRC) sebagai lembaga kemanusiaan konsisten dalam memberikan bantuan terhadap korban konflik bersenjata dan Kedua apakah hambatan International Committee of The Red Cross (ICRC) dalam memberikan bantuan kemanusiaan pada konflik bersenjata di suriah .Penelitian ini termaksud jenis penelitian yuridis normatif, yang ditinjau dari sifatnya bersifat deskriptif. Jenis data yang digunakan adalah data sekunder yang meliputi bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier dan data primer yang berupa wawancara terstruktur. Teknik pengumpulan data yang digunakan, yaitu studi pustaka. Hasil penelitian ini menunjukan bahwa, pertama berkaitan eksistensi dan konsistensi ICRC dalam sebuah konflik bersenjata menurut Statuta ICRC bahwa ICRC merupakan organisasi yang memberikan bantuan kemanusiaan di segala konflik bersenjata di dunia, bahwa pada saat ini ICRC terus memberikan bantuanya di konflik suriah dilihat dari kenaikan bantuan setiap tahunya dan Kedua, hambatan yang terjadi lebih banyak melibatkan negara, negara tidak mengerti pentingnya Statuta ICRC dan Konvensi Jenewa IV, akibatnya ICRC mengalami kesulitan untuk menjangkau korban yang terkena dampak paling besar.
