Abstract
LEGAL PROTECTION OF OWNERSHIP OF CERTIFICATES IN LIEU OF LAND RIGHTS ISSUED BY THE NATIONAL LAND AGENCY ACCORDING TO LAW NUMBER 5 OF 1960 CONCERNING BASIC AGRARIAN LAWS (Case Study of State Administrative Court Decisions Number 31/6/2018/PTUN.BDG ). Based on Article 109 paragraph (4) and (5) of the Regulation of the State Minister of Agrarian Affairs/Head of the National Land Agency Number 3 of 1997 concerning Implementing Provisions of Government Regulation Number 24 of 1997 concerning Land Registration, that a replacement certificate can be issued from the auction results whose certificates are not included in the auction process. The problem that occurs is, when the auction winner submits an application for a replacement certificate, it is rejected by the National Land Agency even though the auction applicant is the winner of the auction as evidenced by the minutes of the auction. This type of research is a normative juridical and case study through a legal approach. Sources of data used in the form of primary, secondary and tertiary legal materials with data collection techniques through literature studies which were analyzed qualitatively. The results of the study show that: (1) The emergence of a replacement certificate for ownership of land rights from the auction results in the Case of the Decision of the State Administrative Court Number 31/6/2018/PTUN.BDG is due to the fact that the SHM object of the execution auction is not included in the auction, considering that the object of the auction has previously been placed on collateral confiscation, general confiscation, and execution confiscation. A replacement certificate will be issued after the three confiscations are crossed out or deleted in accordance with applicable regulations, and all required obligations of the winning bidder have been fulfilled. (2) The legal protection that can be given to the application for a replacement certificate as the winner of the auction is preventive legal protection in several forms. First, the auction winner has been given the opportunity to take legal action through a lawsuit in court related to the application for the issuance of a replacement certificate. Second, the winner of the auction has been given a quote from the minutes of the auction as a deed of sale and purchase of the object of the auction and as one of the conditions for the transfer of rights to the land resulting from the auction. Third, the winner of the auction is contained in the minutes of the auction, which is the official report of the auction made by the auction official as an authentic deed and has perfect evidentiary power.

Permasalahan yang terjadi adalah, ketika pemenang lelang mengajukan permohonan sertifikat pengganti ditolak oleh Badan Pertanahan Nasional padahal pemohon lelang adalah sebagai pemenang lelang yang dibuktikan dengan risalah lelang. Jenis penelitian ini adalah yuridis normatif dan studi kasus melalui pendekatan undang-undang. Sumber data yang digunakan berupa bahan hukum primer, sekunder dan tersier dengan teknik pengumpulan data melalui studi kepustakaan yang dianalisis secara kualitatif. Hasil penelitian menunjukan, bahwa: (1) Timbulnya sertifikat pengganti atas kepemilikan hak atas tanah dari hasil lelang pada Kasus Putusan Pengadilan Tata Usaha Negara Nomor 31/6/2018/PTUN.BDG disebabkan oleh karena SHM objek lelang eksekusi tidak diikutsertakan dalam pelaksanaan lelang, mengingat objek lelang tersebut sebelumnya telah diletakkan sita jaminan, sita umum, dan sita eksekusi. Sertifikat pengganti akan diterbitkan setelah ketiga sita tersebut dicoret atau dihapus sesuai dengan ketentuan yang berlaku, dan seluruh kewajiban pemenang lelang yang telah dipersyaratkan telah dipenuhi. (2) Perlindungan hukum yang dapat diberikan kepada Pemohonan sertifikat pengganti sebagai pemenang lelang adalah perlindungan hukum preventif dengan beberapa bentuk. Pertama, Pemenang lelang telah diberikan kesempatan menempuh jalur hukum melalui gugatan di pengadilan terkait dengan permohonan untuk penerbitan sertifikat pengganti. Kedua, Pemenang lelang telah diberikan kutipan risalah lelang sebagai akta jual beli obyek lelang dan sebagai salah satu syarat pemindahan hak atas tanah hasil lelang. Ketiga, pemenang lelang terdapat dalam risalah lelang, yang merupakan berita acara pelaksanaan lelang yang dibuat oleh pejabat lelang sebagai akta otentik dan mempunyai kekuatan pembuktian sempurna. | |||||||||
