Abstract

THALAQ THROUGH GADGET (Handphone ) REVIEW FROM ISLAMIC LAW PERSPECTIVE AND LAW NUMBER 16 YEAR 2019 TO AMENDMENT TO LAW NUMBER 1 YEAR 1974 CONCERNING MARRIAGE (Case study in Kubang Village, Sukamulya District, Tengerang Regency) Hidayatul Awaliah 1111180122 ABSTRACT Married life through marriage is one of the pages of life that will be passed by every human being. Marriage aims to realize a sakinah, mawaddah, and rahmah household life. Marriage under Islamic law and positive law must be subject to the compilation of Islamic law (KHI) and law number 16 of 2019 for changes to applicable law number 1 of 1974. Like the case study, thalaq only goes through social media. Therefore, the researcher will discuss whether thalaq through gadgets is legal according to Islamic law and law number 16 of 2019 for changes to law number 1 of 1974? and What are the legal consequences for the occurrence of thalaq to the wife for thalaq through gadgets. This study uses the theory of legal certainty and the theory of maslahah al-mursalah. The research method used is empirical juridical, with research specifications in the form of descriptive analysis, data sources in the form of primary data, data collection techniques in the form of library research, data analysis using qualitative analysis and research locations in the library of the Faculty of Law, Sultan Ageng Tirtayasa University. . the results of the thesis research that the author did, it was found that divorce through gadgets (mobile phones) has no legal force and is not regulated in law number 16 of 2019 for changes to law number 1 of 1974 concerning marriage. Then the legal consequence that occurs is that the thalaq spoken by the husband is only valid in Islamic law, but does not have legal force according to applicable law in Indonesia. As for suggestions from the author, it would be nice if the current technological developments could be handled wisely so that technology users can have a positive influence on the development of the nation and religion.. Hidayatul Awaliah 1111180122 ABSTRAK Kehidupan Berumah tangga melalui pernikahan merupakan salah satu lembaran hidup yang akan dilalui oleh setiap manusia. Perkawinan bertujuan untuk mewujudkan kehidupan rumah tangga yang sakinah, mawaddah, dan rahmah. perkawinan secara hukum islam dan hukum positif harus tunduk pada kompilasi hukum islam (KHI) dan undang-undang nomor 16 tahun 2019 atas perubahan undang-undang nomor 1 tahun 1974 yang berlaku. Seperti studi kasus thalaq hanya melalui meida social. Maka dari itu peneliti akan membahas Apakah sah thalaq melalui gadget menurut hukum islam dan undang – undang nomor 16 tahun 2019 atas perubahan undang – undang nomor 1 tahun 1974 ? dan Apa akibat hukum atas terjadinya thalaq kepada istri atas thalaq melalui gadget. Penelitian ini menggunakan teori kepastian hukun dan teori maslahah al-mursalah. Metode penelitian yang digunakan adalah Yuridis empiris, dengan spesifikasi penelitian berupa deskriptif analisis , sumber data berupa data primer , teknik pengumpulan data berupa penelitian kepustakaan, analisis datanya menggunakan analisis kualitatif dan lokasi penelitian didalam perpustakaan Fakultas Hukum Universitas Sultan Ageng Tirtayasa Dan mewawancarai Terhadap Permasalahan kasus tersebut. hasil penelitian skripsi yang penulis lakukan didapati bahwasannya perceraian melalui gadget ( handphone) Tidak memiliki kekuatan hukum dan tidak diatur dalam undang - undang nomor 16 tahun 2019 atas perubahan undang – undang nomor 1 tahun 1974 tentang perkawinan. Kemudian akibat hukum yang terjadi yaitu thalaq yang diucapkan suami hanya sah dalam hukum islam saja , tetapi Tidak memiliki kekuatan hukum menurut hukum yang berlaku di Indonesia. Adapun saran dari penulis Alangkah baiknya perkembangan teknologi yang ada saat ini bisa disikapi dengan bijaksana agar pengguna teknologi dapat pengaruh positif bagi perkembangan bangsa dan agama. Kata kunci : Thalaq , hukum , gadget ( handhpone )
