Abstract
epresentative system demokracy is the application of supervision and balance between reresentative systems. In the Constitution the third amandement stated that the people’s consultative assembly consisted of the House of Representatives and the Regional Representative Council, which means that the system of representation of our councry is more than one room. Based on the description on the background above, the author formulates the problem as follows : First, what is the position of the Regional Representative Council in representative system democracy in Indonesia; Second, what is the proper function of the Regional Representative Council as a representative body of the people accourding to the 1945 Constitution. The method used in writing this essay is descriptive with a normative juridical approach, namely conducting research focusing on problems as they are when the research is carried out, the results of the study were then processed and analyzed for conclusions, only from literature. In the case of the existence of a representative institution in a reresentative system of more than one room, it is deemed necessary to give the same or at least almost equal authority or have special rights in order to achieve supervision and balance between representative institutions. The tasks that have been carried out by the Regional Representative Council have not yet become public consumption because there is no clear accountability mechanism, even though the essence of the representative is the presence of the group to represent the interests represented, the representative party should be accountable to the party represented. | Additional Information: | Demokrasi sistem perwakilan merupakan penerapan pengawasan dan keseimbangan diantara sistem perwakilan. Dalam Undang-Undang Dasar tahun 1945 hasil Amandemen ketiga menyatakan bahwa Majelis Permusyawaratan Rakyat terdiri atas Dewan Perwakilan Rakyat dan Dewan Perwakilan Daerah, yang berarti sistem perwakilan negara kita adalah lebih dari satu kamar. Berdasarkan uraian pada latar belakang diatas, penulis merumuskan permasalahan sebagai berikut : Pertama, Bagaimana kedudukan Dewan Perwakilan Daerah dalam demokrasi sistem perwakilan di Indonesia; Kedua, Bagaimana fungsi Dewan Perwakilan Daerah yang tepat sebagai lembaga perwakilan rakyat menurut Undang-Undang Dasar tahun 1945. Metode yang digunakan dalam penulisan skripsi ini adalah deskriptif dengan pendekatan yuridis normatif yaitu melakukan penelitian memusatkan perhatian kepada masalah-masalah sebagaimana adanya saat penelitian dilaksanakan, hasil penelitian yang kemudian diolah dan dianalisis untuk diambil kesimpulan dengan hanya bersumber dari kepustakaan. Perihal eksistensi suatu lembaga perwakilan dalam sistem perwakilan lebih dari satu kamar maka dipandang perlu memberikan kewenangan yang setara atau setidaknya hampir setara atau memiliki hak-hak istimewa demi tercapainya pengawasan dan keseimbangan diantara lembaga perwakilan. Tugas yang telah dilaksanakan Dewan Perwakilan Daerah selama ini belum menjadi konsumsi publik karena tidak ada mekanisme pertanggungjawaban yang jelas, padahal esensi dari perwakilan adalah kehadiran kelompok tersebut untuk mewakili kepentingan yang diwakili, maka sudah seharusnya pihak yang mewakili bertanggungjawab kepada pihak yang diwakili.
