Abstract

JURIDICAL REVIEW CRIMINAL LIABILITY AGAINST PERFORMERS OF BETWEEN SUPPORTER VIOLENCE SOCCER (LEAGUE 3) (Study of Decision on Case Number 144/Pid.B/2018/PN.Pml) BIMO MARTHA WISUNA PUTRO 1111160157 ABSTRACT Collective violence crimes are very common, where many of the perpetrators are not identified, only people who are caught will be punished, while those who are not caught are free and do not get any punishment. This makes collective acts of violence relied on as a means of revenge without worrying about being punished. There are also many incidents in football that invite the occurrence of criminal acts committed by supporters such as the beating of soccer supporters which resulted in serious injuries to the head and the destruction of public facilities and bus vehicles in Taman Patih Sampun Pemalang, where the punishment was very light, from this background There is problem identification. namely how is the accountability for violent crimes between football supporters and how is the judge's consideration in deciding the perpetrators of violence between soccer supporters. This study uses the theory of criminal responsibility and the theory of judges' judgment. Furthermore, the method used in the preparation of this thesis uses a normative juridical method, with the research approach used is the legislation (statue approach) and the case approach (case approach). Sources of data used in this study is secondary data and is equipped with primary data, using data collection techniques, namely by means of library research and field research. Judges in deciding cases must provide a deterrent effect to perpetrators of beatings, in carrying out their responsibilities the perpetrator in his sentence is already responsible but the punishment given is very light. Second, the judge's consideration in deciding the case, because the eight month sentence does not really provide a deterrent effect to other supporters if there is a riot like this again, the judge must prioritize other considerations in terms of the losses suffered by the victim, so that the perpetrators or other supporters do not follow or retaliate. revenge against other football clubs Keywords: Criminal Liability, Violence, Supporter.

Hal ini membuat perbuatan kekerasan secara kolektif di andalkan sebagai ajang balas dendam tanpa khawatir terkena hukuman. Banyak juga kejadian dalam sepak bola yang mengundang terjadinya tindak pidana yang dilakukan oleh supporter seperti pengeroyokan terhadap suporter sepak bola yang mengakibatkan korban luka berat dikepala dan pengrusakan fasilitas umum dan kendaraan bus di Taman Patih Sampun Pemalang, dimana pemidanaannya nya sangatlah ringan, dari latar belakang tersebut terdapat identifikasi masalah. yaitu bagaimanakah pertanggungjawaban tindak pidana kekerasan antar supporter sepak bola dan bagaimanakah pertimbangan hakim dalam memutus pelaku kekerasan antar supporter sepak bola. Penelitian ini menggunakan teori pertanggungjwaban pidana dan teori pertimbangan hakim. Selanjutnya metode yang digunakan dalam penyusunan skripsi ini menggunakan metode yuridis normatif, dengan pendekatan penelitian yang digunakan adalah perundang-undangan (statue approach) dan pendekatan kasus (case approach). Sumber data yang digunakan pada penelitian ini adalah data sekunder dan dilengkapi dengan data primer, dengan menggunakan teknik pengumpulan data yaitu dengan cara penelitian kepustakaan dan penelitian lapangan. Hakim dalam memutus perkara harus memberikan efek jera kepada pelaku pengeroyokan, dalam pelaksanaan pertanggung jawabannya pelaku dalam hukuman nya sudah bertanggungjawab namun hukuman yang diberikan sangat ringan. Kedua, Pertimbangan hakim dalam memutus perkara, karena hukuman delapan bulan sangat tidak memberikan efek jera kepada supporter yang lain bila terdapat kerusuhan seperti ini lagi, hakim harus lebih mengedepankan pertimbangan lainnya dari segi kerugian yang korban alami, schingga pelaku atau supporter lainnya tidak mengikuti atau balas dendam kepada klub sepak bola lainnya Kata Kunci: Pertanggungjawaban Pidana, Kekerasan, Supporter.
