Abstract

Menurut European Space Agency (ESA) space debris dapat dikenal sebagai orbital debris, space junk, space waste, space trash, space little atau space garbage ialah sebagai benda non fungsional buatan manusia. Kasus jatuhnya satelit Kosmos 954 milik Rusia di wilayah Kanada tentu menimbulkan tanggung jawab secara mutlak yang dalam hal ini diatur dalam Article II Liability Convention 1972. Masalahnya adalah pertama, bagaimanakah tanggung jawab negara peluncur dalam penanggulangan sampah ruang angkasa (space debris) ditinjau dari Liability Convention 1972? Kedua, bagaimanakah implementasi Liability Convention 1972 terhadap kasus jatuhnya satelit Rusia di wilayah Kanada? Penelitian ini dilakukan dengan menggunakan metode penelitian yuridis normatif dengan menggunakan sumber data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data dilakukan dengan studi kepustakaan dan analisis yang dipakai pada penulisan ini menggunakan analisis kualitatif dengan cara menggambarkan atau memaparkan subjek atau objek penelitian. Adapun hasil penelitian ini adalah pertama, berdasarkan Liability Convention 1972 terdapat empat bentuk tanggung jawab negara peluncur, yaitu tanggung jawab secara mutlak, tanggung jawab atas kesalahan, tanggung jawab bersama dan pembebasan dari tanggung jawab. Kedua, Implementasi Liability Convention 1972 dalam kasus Kosmos 954 memang sudah terpenuhi tapi tidak secara utuh seperti lamanya pembayaran kompensasi, tidak diadakannya Claim Commision, dan juga Rusia tidak memberikan informasi kepada Kanada mengenai kandungan material yang terdapat pada satelit Kosmos 954

Additional Information: According to the European Space Agency (ESA), space debris can be known as orbital debris, space junk, space waste, space trash, space little or space waste as non-functional human-made objects, including fragments and elements in orbit or re-entering the Earth's atmosphere. The case of the fall of Russia's Cosmos 954 satellite in Canada certainly creates absolute responsibility according to Article II Liability Convention 1972. The author is interested in examining how the liability of the launching state for the management of space debris in therms of Liability Convention 1972? And how is the implementation of the Liability Convention 1972 in the case of the fall of Russia‟s satellite on Canadian territory? This research uses juridical-normative and then research method using secondary data sources complete with primary legal materials, secondary legal materials, and tertiary legal materials. The data technique is a literature research and research analysis used in this study using qualitative analysis by describing or describing the subject or object of research. The results of this study are first, based on the 1972 Liability Convention, there are four forms of responsibility for the launching state, namely absolute responsibility, responsibility for mistakes, joint responsibility and release from responsibility. Second, the implementation of the 1972 Liability Convention in the case of Kosmos 954 has indeed been fulfilled but not completely, such as the length of time for compensation payments, the absence of a Claim Commission, and also Russia did not provide information to Canada regarding the material content contained in the Kosmos 954 satellite.
