Abstract

Penerapan system Elektronic Banking selain bermanfaat dalam rangka efesiensi juga menyisakan berbagai permasalahan hukum yang dapat mengakibatkan kerugian terhadap para nasabah. Berdasarkan hal tersebut maka perlu adanya suatu pengaturan yang jelas mengenai hak dan kewajiban para pihak serta pengaturan mengenai tanggung jawab bank apabila terjadi kerugian pada nasabah. Terjadinya berbagai permasalahan yang dialami oleh nasabah dalam penerapan system E-Banking berakibat menurunnya kepercayaan nasabah kepada bank. Penulisan skripsi ini didalamnya juga dilakukan penelitian mengenai tanggung jawab bank dalam penerapan system E-Banking apabila timbul kerugian nasabah. Penelitian ini bertujuan untuk mengetahui tanggung jawab bank apabila terjadi kerugian kepada nasabah akibat kesalahan bank. Penelitian ini bersifat deksriptif analitis dengan metode yuridis normatif. Penarikan kesimpulan dari hasil penelitian yang telah terkumpul dilakukan dengan metode analisis normatif kualitatif. Berdasarkan hasil penelitian diketahui bahwa belum ada peraturan yang mengatur secara jelas mengenai tanggung jawab bank kepada nasabah dalam penerapan system Elektronic Banking tetapi berdasarkan Surat Keputusan Direksi Bank Indonesia Nomor:23/73/KEP/DIR Tanggal 28 Februari 1991 Tentang Pengolahan Data Elektronic Oleh Bank, Pasal 2 menyebutkan bahwa Bank dapat menyelenggarakan pengolahan data elektronis sendiri atau menggunakan jasa pihak lain. Pasal 3 menyebutkan bahwa dalam menyelenggarakan pengolahan data elektronis tersebut bank wajib memliki rencana serta system pelaksanaan yang terpadu, menetapkan secara jelas personil yang bertanggung jawab atas pengoperasian dan pengembangannya, memiliki dokumentasi perangkat lunak dan perangkat keras serta memliki rencana penaggulangan (Back Up Contigency) dalam rangka menjaga keamanan dan kelangsungan operasinya. Upaya perlindungan hukum kepada nasabah dilakukan dengan adanya asas kehati-hatian, asas kepercayaan dan asas kerahasiaan bank wajib diterapkan oleh setiap bank. Hal ini sesuai dengan Undang-Undang Nomor 10 Tahun 1998 Tentang 1998 Tentang Perbankan Pasaal 2 bahwa Perbankan Indonesia dalam melakukan usahanya berdasarkan demokrasi ekonomi dengan menggunakan prinsip kehatihatian. Berdasarkan uraian tersebut dapat disimpulkan bahwa bank dalam undangan yang ada khususnya Surat Keputusan Direksi Bank Indonesia Nomor: 23/73/KEP/DIR Tanggal 28 Februari Tentang Pengolahan Data Elektronic Oleh Bank dan Undang-Undang Nomor 10 Tahun 1998 Tentang Perbankan

Additional Information: The application of the Electronic Banking system is not only beneficial interms of efficiency but also leaves various legal problems that can cause losses to customers. Based on this, it is necessary to have a clear regulation regarding the rights and obligations of the parties as well as regulations regarding bankresponsibilities in the event of a loss to the customer. The occurrence of variouproblems experienced by customers in implementing the E-Banking systemresulted in decreased customer confidence in the bank. The writing of this thesisincludes research on the responsibilities of the bank in implementing the EBanking system in the event of customer losses. This study aims to determine the bank's responsibility in the event of a loss to customers due to bank errors. Thisresearch is analytical descriptive with normative juridical method. Withdrawingconclusions from the research that has been collected is carried out by usingqualitative normative analysis methods. Based on the results of the study, it known that there are no clear regulations regarding the responsibility of banks to customers in implementing the Electronic Banking system but based on the Decree of the Board of Directors of Bank Indonesia Number: 23/73 / KEP / DIdated February 28, 1991 concerning Electronic Data Processing by BankArticle 2 states that Banks can carry out electronic data processing by themselveor use the services of other parties. Article 3 states that in carrying out electronidata processing, a bank is required to have an integrated implementation planand system, clearly define the personnel responsible for its operation anddevelopment, have software and hardware documentation and have a back upcontingency plan in the framework of maintain safety and continuity of operations. Legal protection measures for customers are carried out with theprecautionary principle, trustworthiness and bank secrecy principles that must beapplied by every bank. This is in accordance with Law Number 10 of 1998concerning 1998 Concerning Banking Article 2, which states that Indonesian banking in conducting its business is based on economic democracy using theprinciple of prudence. Based on the description, it can be concluded that the bankin the existing invitation, especially the Decree of the Board of Directors of BankIndonesia Number: 23/73 / KEP / DIR dated February 28 concerning ElectroniData Processing by Banks and Act Number 10 of 1998 concerning Banking
