Abstract

Rani Sri Sumarsih seorang pemegang polis Asuransi Jiwa Bersama Bumiputera dalam Mitra Beasiswa untuk anaknya Alif Ramadhan Arrasyad dengan nomor polis 2002141908 yang sudah jatuh tempo dan harus mencairkan klaim asuransi pada tanggal 02 April 2019 ingin mencairkan dana asuransi beasiswa sebesar Rp20.419.000,00. Namun AJB Bumiputera terlambat membayar klaim asuransi karena mismatch aset dan kewajiban. Dan AJB Bumiputera memberikan jaminan, karena dari pihak OJK telah mengatur dalam PJOK. Namun dalam hal ini pihak pemegang polis merasa dirugikan atas keterlambatan pembayaran klaim asuransi tidak sesuai dengan kontrak perjanjian. Peneliti mengkaji akibat hukum yang timbul atas keterlambatan pembayaran klaim asuransi beasiswa pasca restrukturisasi dihubungkan dengan Undang-undang No. 40 Tahun 2014 tentang perasuransian dan Keputusan Menteri Keuangan Nomor 422/KMK.06/2003. Metode penelitian yang digunakan adalah metode kualitatif dengan jenis penelitian yuridis normatif. Sumber data yang digunakan adalah data sekunder dengan data primer sebagai penunjang berupa wawancara. Hasil penelitian ini menunjukkan bahwa akibat hukum yang timbul atas keterlambatan pembayaran klaim asuransi beasiswa AJB Bumi Putera Cabang Cilegon dihubungkan dengan Undang-undang No. 40 Tahun 2014 tentang perasuransian dan POJK Nomor 69/POJK.05/2016 tentang Penyelenggaraan Usaha Perusahaan Asuransi berupa Pengenaan sanksi administratif berupa peringatan tertulis dilakukan paling banyak 3 (tiga) kali berturut-turut atas setiap pelanggaran. Jangka waktu pemberlakuan sanksi administratif berupa peringatan tertulis bagi Perusahaan Asuransi masing-masing paling lama 30 (tiga puluh) hari sejak ditetapkannya sanksi administratif tersebut. Perusahaan Asuransi akan dikenai sanksi administratif berupa pembatasan kegiatan usaha apabila Perusahaan Asuransi tersebut tidak dapat mengatasi pelanggaran yang merupakan penyebab terbitnya sanksi peringatan tertulis terakhir sampai dengan jangka waktu yang sudah ditentukan. Untuk pembatasan kegiatan usaha ini bisa untuk sebagian ataupun seluruh kegiatan usaha. Apabila dengan dikenakannya sanksi pembatasan kegiatan usaha untuk seluruh kegiatan usaha tetapi Perusahaan Asuransi masih tidak dapat mengatasi pelanggaran yang ada barulah sanksi terberat yang akan dikenakan yaitu pencabutan izin usaha Perusahaan Asuransi tersebut.

Based on this background, the researcher examined the legal consequences arising from late payments. post�restructuring scholarship insurance claims related to Law no. 40 of 2014 concerning insurance and the Decree of the Minister of Finance Number 422 / KMK.06 / 2003. The research method used is a qualitative method with normative juridical research. The data source used is secondary data with primary data as a support in the form of interviews. The results of this study indicate that the legal consequences arising from the late payment of the AJB Bumi Putera scholarship claim at the Cilegon Branch are connected with Law No. 40 of 2014 concerning insurance and POJK Number 69 / POJK.05 / 2016 concerning the Implementation of Insurance Company Business in the form of the imposition of administrative sanctions in the form of written warnings carried out at most 3 (three) consecutive times for each violation. The period for the application of administrative sanctions in the form of a written warning for each Insurance Company is no longer than 30 (thirty) days from the stipulation of the administrative sanctions. The Insurance Company will be subject to administrative sanctions in the form of restrictions on business activities if the Insurance Company is unable to resolve the violation which caused the issuance of the last written warning sanction up to a predetermined period of time. To limit business activities, this can be for part or all of business activities. If the imposition of sanctions for limiting business activities for all business activities but the Insurance Company is still unable to overcome the existing violations, then the heaviest sanction will be imposed, namely the revocation of the Insurance Company's business license.
