Abstract
Karya Fotografi merupakan salah satu ciptaan yang dilindungi oleh UUHC yaitu diatur pada Pasal 40 huruf k. Keberadaan karya fotografi berkembang sejalan dengan perkembangan dunia fotografi, yang saat ini fotografi sudah tidak menggunakan film lagi untuk merekam gambar tetapi sekarang menggunakan digital file. Dengan adanya digital file tersebut, memudahkan siapa saja untuk melakukan pelanggaran hak cipta seperti yang telah terjadi terhadap karya fotografi berupa foto milik Pewarta Foto Jefri Tarigan yang diambil dan digunakan tanpa izin oleh PT. Tribun Digital Online (Tribunnews.com) untuk kegiatan komersial. Yang mana perbuatan tersebut telah melanggar hak moral dan hak ekonomi pencipta maupun pemegang hak cipta. Maka identifikasi masalah dari penelitian ini membahas tentang perlindungan hukum atas penggunaan foto tanpa izin milik Pewarta foto Jefri Tarigan oleh PT. Tribun Digital Online (Tribunnews.com) berdasarkan Undang-undang Nomor 28 Tahun 2014 tentang Hak Cipta dan bagaimana penyelesaian hukum atas pelanggaran hak cipta milik Pewarta foto Jefri Tarigan oleh PT. Tribun Digital Online (Tribunnews.com) berdasarkan Undang-undang Nomor 28 Tahun 2014 tentang Hak Cipta. Metode penelitian yang digunakan adalah normatif-empiris dengan pendekatan undang-undang (statue approach) dan pendekatan kasus (case approach). Adapun data yang digunakan adalah data sekunder yang diperoleh dari studi kepustakaan dengan dilengkapi data primer yaitu wawancara, serta analisis data yang digunakan adalah secara kualitatif dengan metode deskriptif. Hasil penelitian menunjukan bahwa perlindungan hukum terhadap karya fotografi milik Jefri Tarigan berupa foto yang diambil dan digunakan oleh PT. Tribun Digital Online (Tribunnews.com) pada artikel-artikel beritanya belum dapat dilindungi, walaupun dalam UUHC sudah jelas bahwa perbuatan tersebut sudah melanggar hak cipta terhadap hak moral (Pasal 5 UUHC) dan hak ekonomi (Pasal 8 dan Pasal 9). Jefri Tarigan bersama kuasa hukum ternyata sudah melakukan upaya-upaya penyelesaian sengketa hak cipta secara non litigasi yaitu mediasi tetapi tidak mencapai kesepakatan dan litigasi yaitu mengajukan gugatan ganti rugi ke Pengadilan Niaga tetapi hakim memutus gugatan tidak dapat diterima (NO) atau ditolak karena Jefri Tarigan kurang pihak dalam gugatannya. Oleh karena gugatannya ditolak maka pencipta dapat mengajukan gugatan ganti rugi kembali sesuai dengan Undang-undang Nomor 28 Tahun 2014 Tentang Hak cipta.

| Additional Information: | Photographic work is one of the works protected by the UUHC, which is regulated in Article 40 letter k. The existence of photographic works develops in line with the development of the world of photography, which currently no longer uses film to record images but now uses digital files. With this digital file, it makes it easier for anyone to commit copyright infringement as has happened to the photographic work of Jefri Tarigan's Photo Journalist which was taken and used without permission by PT. Tribun Digital Online (Tribunnews.com) for commercial activities. Which of these acts violates the moral and economic rights of the creator and the copyright holder. So the identification of problems from this research discusses the legal protection of the use of photos without permission belonging to the photo reporter Jefri Tarigan by PT. Tribun Digital Online (Tribunnews.com) based on Law Number 28 of 2014 concerning Copyright and how the legal settlement of copyright infringement of Jefri Tarigan's photo journalist by PT. Tribun Digital Online (Tribunnews.com) based on Law Number 28 of 2014 concerning Copyright. The research method used is normative-empirical with a statute approach (statue approach) and a case approach (case approach). The data used are secondary data obtained from literature studies equipped with primary data, namely interviews, and data analysis used is qualitative with descriptive methods. The results showed that the legal protection of Jefri Tarigan's photographic works in the form of photos taken and used by PT. Tribun Digital Online (Tribunnews.com) in its news articles can not be protected, even though in the UUHC it is clear that this act has violated copyright against moral rights (Article 5 UUHC) and economic rights (Article 8 and Article 9). It turns out that Jefri Tarigan and his attorney have made non-litigation efforts to resolve copyright disputes, namely mediation but did not reach an agreement and litigation, namely filing a lawsuit for compensation to the Commercial Court but the judge decided that the lawsuit could not be accepted (NO) or was rejected because Jefri Tarigan was lacking party to the lawsuit. Because the lawsuit is rejected, the creator can file a claim for compensation again in accordance with Law Number 28 of 2014 concerning Copyright.
