Abstract

Pengelolaan barang milik daerah merupakan suatu urgensi agar dapat tercatat dengan jelas aset yang dikuasai oleh Pemerintah Kota Tangerang Selatan supaya aset tersebut tidak disalahgunakan oleh pihak lain yang nantinya justru merugikan Pemerintah Kota Tangerang Selatan itu sendiri. Pengelolaan barang milik daerah yang baik juga merupakan wujud terciptanya tata kelola pemerintahan yang baik untuk mencapai tujuan dan cita-cita daerah tersebut sehingga penyelenggaraan pemerintahan dan pembangunan dapat berlangsung secara berdayaguna, berhasilguna, serta bebas dari korupsi, kolusi dan nepotisme. Penulis tertarik meneliti tentang: Bagaimana prosedur dalam pengelolaan barang milik daerah di Badan Pengelolaan Keuangan dan Aset Daerah Kota Tangerang Selatan? dan Apa kendala Badan Pengelolaan Keuangan dan Aset Daerah Kota Tangerang Selatan dalam mengelola barang? Penelitian ini menggunakan metode yuridis empiris dengan melihat sesuatu kenyataan hukum di dalam Pemerintahan Kota Tangerang Selatan. Data yang digunakan dalam penelitian ini adalah data yang diperoleh dari data sekunder berupa bahan hukum primer yaitu peraturan perundang-undangan dan data primer berupa wawancara dengan Kepala Bidang Aset Badan Pengelolaan Keuangan dan Aset Daerah Kota Tangerang Selatan untuk melengkapi data yuridis empiris serta dianalisis secara deskriptif kualitatif. Hasil dari penelitian ini diketahui bahwa prosedur pengelolaan barang di Pemerintahan Kota Tangerang Selatan telah didasari dengan Peraturan Daerah Kota Tangerang Selatan Nomor 8 Tahun 2017 namun secara petunjuk dan teknisnya belum diatur secara rinci sehingga masih mengacu pada hierarki peraturan perundangundangan di atasnya yaitu Peraturan Menteri Dalam Negeri Nomor 19 Tahun 2016 tentang Pedoman Pengelolaan Barang Milik Daerah yang dimaksudkan untuk mengakomodir dinamika pengelolaan barang milik daerah, mempertegas hak, kewajiban dan tanggungjawab pengelola. Kendala lain yang timbul terkait pengelolaan aset dikarenakan pemekaran wilayah yang dilakukan Kota Tangerang Selatan menimbulkan permasalahan hukum yang membuat Pemerintah Kota Tangerang Selatan harus membayar ganti rugi yang cukup besar dan belum dibuat suatu regulasi baru yang mengatur perlindungan hukum terhadap pengelolaan barang milik daerah.

Additional Information:	The management of regional owned property is urgency so that the assets controlled by the South Tangerang City Government can be clearly recorded so that these assets are not misused by other parties which in turn will harm the South Tangerang City Government itself. Good management of regional property is also a form of good governance to achieve the goals and ideals of the region so that government and development can progress with efficient, effective, free from corruption, collusion and nepotism. The researcher was interested in researching about: How are the procedures for managing regional property in the Regional Financial and Asset Management Agency of South Tangerang City? and What are the constraints of the South Tangerang City Regional Financial and Asset Management Agency in managing goods? This research used an empirical juridicial method by looking at a reality of law in the South Tangerang City Government. The data used in this research were data obtained from secondary data in the form of primary legal materials, namely statutory regulations and primary data in the form of interviews with the Head of the Regional Financial and Asset Management Division Agency of South Tangerang City to complete empirical juridical data and to be analysed in descriptive qualitative. The results of this research showed that the procedures for managing goods in the City Government of South Tangerang have been based on the Regional Regulation of the City of Tangerang Selatan Number 8 year 2017, but the instructions and technicalities have not been regulated in detail so that they still refer to the hierarchy of laws and regulations above, namely the Minister of Internal Affairs Regulation Number 19 year 2016 about Guidelines for the Management of Regional Property which are intended to accommodate the dynamics of the management of regional property, emphasizing the rights, obligations and the manager’s responsibilities. Another obstacle that raised related to asset management due to the expansion of the area carried out by the City of South Tangerang has created legal problems that make the South Tangerang City Government have to pay a large amount of compensation and a new regulation has not been made that regulates the legal protection of the management of regional property.
