Abstract
Children are the future generation, so if we want our nation forward and strong, we must pay attention to the development and protection of children. The living conditions of today's increasingly complex society. Advances in technology are making the higher efficiency in various areas resulting in many layoffs, and the little employment available. The more open flow of information so that not only the right information easily accessible to the public but also the bad information. Community's economy is increasingly difficult. Circulation of Drugs, alcohol and pornographic images are increasingly widespread. This is exacerbated by an educational system that is more about the value of the exact value of the test subjects and the lack of moral education, ethics and morals in schools, creating pressure on the children and young people harder, so more and more young children in conflict with the law. Before the enactment of UU No. 3 tahun 1997 tentang Pengadilan Anak (Law no. 3 of 1997 on Juvenile Justice ) , legislation that provides protection against children in conflict with the law is lacking, in the Code of Criminal ( Kitab Undang Undang Hukum Pidana ) only arranged in three chapters, namely chapters 45, 46 and 47 only. With the enactment of Law no. 3 of 1997 on the Juvenile Justice Act began there that specifically regulate juvenile court.While in Law no. 3 of 1997 on Juvenile Court has arranged some protection against bad boy, but people feel that protection is not enough to adequately protect children in conflict with the law, the government enacted Law no. 11 in 2012 on the Criminal Justice System Children, which applied since 1 August 2014. In Law no. 11 in 2012 on Children's Criminal Justice System, there is a significant improvement in the protection of children in conflict with the law, which was given not only to the protection of children in conflict with the law, but also be given to children who are victims of crime and children who witness acts criminal. Protection is also provided through the diversion agency, which for the first time in the legislation of the Republic of Indonesia is set on the diversion, the criminal settlement outside the court. In this thesis discussed about Legal comparison juvenile justice program in Law no. 3 1997 by Law No. 11 of 2012, also discussed about how the rules on Diversion and on improving the protection of children through the application of such diversion.

| Additional Information: | Anak adalah generasi penerus bangsa, oleh karena itu apabila kita ingin bangsa kita maju dan kuat maka kita harus memperhatikan pembinaan dan perlindungan terhadap anak.Kondisi kehidupan masyarakat saat ini semakin kompleks. Kemajuan teknologi yang semakin tinggi membuat efisiensi di berbagai bidang mengakibatkan banyaknya pemutusan hubungan kerja, serta semakin sedikitnya lapangan kerja yang tersedia . Semakin terbukanya arus informasi sehingga bukan hanya informasi yang baik saja dengan mudah dapat diakses masyarakat tetapi juga informasi yang buruk. Perekonomian masyarakat yang semakin sulit . Peredaran Narkoba , miras dan gambar gambar porno yang semakin marak. Hal tersebut diperburuk dengan sistem pendidikan yang lebih mengutamakan nilai nilai ujian mata pelajaran eksakta dan kurangnya pendidikan moral, etika dan akhlak di sekolah sekolah, membuat tekanan terhadap anak anak dan generasi muda semakin keras, sehingga semakin banyak anak anak yang berhadapan dengan hukum. Sebelum berlakunya UU No. 3 tahun 1997 tentang Pengadilan Anak, peraturan yang memberikan perlindungan terhadap anak anak yang berhadapan dengan hukum sangat kurang, dalam Kitab Undang Undang Hukum Pidana hanya diatur dalam 3 pasal, yaitu pasal 45, 46 dan 47 saja. Dengan berlakunya UU No. 3 tahun 1997 tentang Peradilan Anak maka mulai ada Undang- Undang yang secara khusus mengatur pengadilan anak. Walaupun dalam UU No. 3 tahun 1997 tentang Pengadilan Anak telah diatur berbagai perlindungan terhadap anak nakal, akan tetapi masyarakat merasa perlindungan tersebut belumlah cukup memadai untuk melindungi anak anak yang berhadapan dengan hukum, maka pemerintah mengundangkan UU No. 11 tahun 2012 tentang Sistem Peradilan Pidana Anak, yang baru diberlakukan tanggal 1 Agustus 2014. Dalam UU No. 11 tahun 2012 tentang Sistem Peradilan Pidana Anak ini, ada peningkatan yang signifikan dalam perlindungan terhadap anak yang berhadapan dengan hukum, dimana perlindungan diberikan bukan hanya terhadap anak yang berkonflik dengan hukum saja tetapi juga diberikan kepada anak yang menjadi korban kejahatan dan anak yang menjadi saksi tindak pidana. Perlindungan juga diberikan melalui lembaga diversi, dimana untuk pertama kalinya dalam perundang-undangan Republik Indonesia diatur mengenai diversi, yaitu penyelesaian perkara pidana diluar proses persidangan di pengadilan.Dalam thesis ini dibahas mengenai perbandingan Hukum acara peradilan anak dalam UU no. 3 tahun 1997 dengan UU no 11 tahun 2012, juga dibahas mengenai bagaimana aturan mengenai Diversi dan tentang peningkatan perlindungan anak melalui penerapan diversi tersebut. | |||||||||
