Abstract
The impact of the most feared drug abuse the facts is the paralysis of the younger generation as the hope of the nation that has the potential of creative, innovative, and productive. Drug abuse can cause mental destruction, damage behavior, rampant crime, and the demoralization of the nation. Abuse and distributing illegal narcotics, an act which is categorized as a criminal offense under Law No. 35 Year 2009 on Narcotics. In the narcotics law the toughest sanctions the death penalty may be imposed to the makers, sellers and couriers of narcotics with the classification of evidence of narcotics over five (5) grams of narcotics not plant and 5 (five) narcotics stems of plants. The method used in this paper is descriptive analysis with normative juridical approach analyzed by Law No. 35 Year 2009 on Narcotics and legal theories and theories of criminology. The identification of the issues discussed are: What is the role of the criminal justice dead against narcotic crime? and How sanction arrangements narcotic crime in Article 114 (2) of Law No. 35 of 2009 on narcotics? Based on the research results should be more observant of justice and can tell which city, the courier, the user, so that the victim can decide the case according to the classification in order to obtain legal certainty. And that Article 114 paragraph 2 of Law No. 35 of 2009 can be applied properly. Setting strict sanctions must be given to abusers of narcotics with the death penalty as the maximum legal limit

| Additional Information: | Dampak dari penyalahgunaan narkotika yang paling dicemaskan adalah lumpuhnya generasi muda sebagai harapan bangsa yang memiliki potensi yang kreatif, inovatif, dan produktif. Penyalahgunaan narkotika dapat menyebabkan kehancuran mental, rusaknya prilaku, maraknya kejahatan, serta terjadinya demoralisasi bangsa. Penyalahgunaan dan mengedarkan secara gelap narkotika, merupakan perbuatan yang dikatagorikan sebagai tindak pidana berdasarkan Undang-undang No. 35 Tahun 2009 Tentang Narkotika. Didalam undang undang narkotika sanksi terberat yakni hukuman mati dapat dijatuhi kepada Pembuat ,penjual dan kurir narkotika dengan klasifikasi barang bukti narkotika diatas 5 (lima) gram narkotika bukan tanaman dan 5 (lima) batang narkotika jenis tanaman.Metode yang dipakai dalam penulisan ini adalah deskriptif analisis dengan pendekatan yuridis normative yang dianalisis dengan Undang-undang No. 35 Tahun 2009 Tentang Narkotika dan teori-teori hukum serta teori-teori kriminologi. Adapun identifikasi masalah yang dibahas adalah : Bagaimana peran peradilan pidana mati terhadap tindak pidana narkotika ? dan Bagaimana pengaturan sanksi tindak pidana narkotika dalam pasal 114 (2) Undang Undang No. 35 Tahun 2009 tentang narkotika?Berdasarkan hasil penelitian maka peradilan harus lebih jeli dan dapat membedakan mana bandar, kurir, pemakai, korban supaya dapat memutuskan perkara sesuai klasifikasi tersebut guna mendapatkan kepastian hukum. Dan agar Pasal 114 ayat 2 Undang-Undang No 35 tahun 2009 dapat diterapkan dengan baik. Pengaturan sanksi yang tegas wajib diberikan kepada penyalah guna narkotika dengan hukuman mati sebagai batas hukum maksimal | |||||||||
