Abstract

World Logistics Transportation in the world plays an important role for a country. Countries that control Logistics then the country will dominate the world. Works driver is part of the world of transportation in the world of logistics. For that very necessary legal instruments in order to protect the driver's employment status at the transportation company. When the device is very clear legal protection, it will help the country make the country prosperous in life. Workers driver / driver to work properly thus contributing to the world of logistics, which in turn contribute to the welfare of Indonesian people in general. Then the mandate of the 1945 Constitution will be realized in the life of the state. Thorough research methodology is indispensable ranging approach that is studying the actual circumstances in life, the specifications of the study through the techniques of collection. Methods of approach in this paper is a type of research a live case study, related to the effectiveness of implementation and legal protection against dualism setting status of workers driver / driver in the PT. Lintas Buana Kasei. This study uses primary and secondary data. Primary data is the research material in the form of empirical facts as well as the result of the behavior of human behavior, whether in the form of verbal behavior, real behavior, and the behavior documented in a variety of behavioral outcomes or records (archives) .To obtain empirical data, in search data, the authors conducted interviews and observations to the location so getting primary data or basic data, such data is the data subject or the main source for this thesis, which was obtained by interview / interview and the observation. The author also examines the source of an agreement between the company and employees in order to get the whole picture and complete. As a result from the research that the correct implementation of the protection of the driver's employment status is accommodated by the Management Company. The company prepared the rule of law to the driver in order to create an excellent work ethic. Due to that the driver can work well.

Dunia Transportasi dalam Dunia Logistik memegang peranan penting bagi suatu negara. Negara yang menguasai Logistik maka negara tersebut akan menguasai dunia. Pekerjaan pengemudi merupakan bagian dari dunia transportasi dalam dunia logistik. Untuk itulah sangat diperlukan perangkat hukum dalam rangka melindungi status pekerja pengemudi pada perusahan transportasi. Apabila perangkat perlindungan hukum sangat jelas, maka akan sangat membantu menjadikan negeri ini negeri yang sejahtera dalam kehidupan. Para pekerja pengemudi/supir dapat bekerja dengan baik sehingga memberikan kontribusi bagi dunia logistik yang baik yang pada akhirnya memberikan sumbangsih bagi kesejahteraan rakyat Indonesia pada umumnya. Maka amanat Undang Undang Dasar 1945 akan terealisasi dalam kehidupan bernegara. Metodologi penelitian yang menyeluruh sangat diperlukan mulai metode pendekatan yaitu mempelajari keadaan aktual dalam kehidupan, spesifikasi penelitian sampai tekhnik pengumpulan. Metode pendekatan dalam tulisan ini adalah jenis penelitian live case study, yang berkaitan dengan efektivitas dan implementasi serta payung hukum terhadap dualisme pengaturan status terhadap para pekerja pengemudi/sopir di PT. Lintas Buana Kasei. Penelitian ini menggunakan Data primer dan sekunder. Data primer merupakan bahan penelitian yang berupa faktafakta empiris sebagai perilaku maupun hasil perilaku manusia, baik dalam bentuk perilaku verbal, perilaku nyata, maupun perilaku yang terdokumentasi dalam berbagai hasil perilaku atau catatan-catatan (arsip).Untuk mendapatkan data empiris, dalam penelusuran data, penulis melakukan interview/wawancara dan observasi ke lokasi sehingga mendapatkan data primer atau data dasar, data tersebut merupakan data pokok atau sumber utama bagi penulisan tesis ini, yang diperoleh dengan wawancara dan observasi tersebut. Penulis juga meneliti sumber perjanjian antara perusahaan dan karyawan agar dapat mendapatkan gambaran yang menyeluruh dan lengkap. Dari hasil penelitian berkesipulan bahwa benar pelaksanan perlindungan status pekerja pengemudi diakomodir oleh Management Perusahaan. Perusahaan menyiapkan perangkat aturan hukum untuk para pengemudinya demi tercipta etos kerja yang sangat baik. Sehungga para pengemudi/supir dapat bekerja dengan baik.
