Abstract

Indonesia is blessed with diversity of biological resources especially fishery resource. Marine resource is often subjected by foreign vessels to take and / or hunt the fishes down without license or known as illegal fishing. The government acts to implement the sanctions of vessel sinking to provide a deterrent effect to the marine resource thieves. The problems identified in this study are about the administration of UNCLOS 1982 against the illegal fishing in order to protect the coastal marine resource and the implementation of sinking policy of KM. Sudhita vessel in Indonesian Exclusive Economic Zone conducted by the Ministry of Maritime Affairs and Fisheries. The method used is a normative juridical with the approach of legislation. Source of data used is a secondary data. Data were analyzed using qualitative normative method. Based on the results of study, it can be known that, firstly the UNCLOS 1982 does not regulate the vessel sinking directly, but the UNCLOS 1982 gives the sovereign rights to the coastal state as the authority to establish the law of fishery in the Exclusive Economic Zone in Article 73 paragraph (1) for the sake of coastal area fishery protection; second, the implementation of Sudhita vessel sinking was conducted by the Ministry of Maritime Affairs and Fisheries based on a court decision of Tanjung Pinang No. 4 / PID.SUS-PRK / 2014 / PN TPG and it was referred to the Law No. 45 of 2009 on Amendments to the Law No. 31 of 2004 of Fisheries and Foreign Vessel Sinking Mechanism in Directorate General of Marine Resources and Fisheries Regulation No. 11 / Per-DJPSDKP / 2014.
