Abstract

ABSTRACT Community workers and businessmen in Indonesia is partofthe world”s leading free-market era. All the actors in the producyion process need to unite and cultivate a professional attitude. However in everyday social interactions, there would be sharp differences of opinion between the employers and the unions. Workers as individuals will not be able to protect and defend their interest and rights, without unions, as unions have full authority to voice their interests and rights of its members (employees), and represent the views, opinions and wishes. Goal to be achieved by the holding of this study was to gain an understanding of the principles of freedom of association and of expression of workes according to the laws and regulations, trade unions and defend their PT.Nikomas Gemilang. The numerous cases of lay of and the prevalence of demonstrations and industrial strikes ini companies in Serang area indicate the weakness of workes protection and the unfulfilmment of workers normative rights (the rights in obtaining work, on getting proper wager, on setting up orgnaisation, on getting protection, on taking have, or crying out strikes and on conducting negotiations) Demonstrations and strikes take place because of the absences of agreement beteween workers on companies on workers demands. In this study, the methods uses was a qualitative one normative yuridical study and empiric yuridical study.therefore, this research was conducted by library research. The data form library research in secondary ata form the subject of primary, secondary and tertiary law. The data collecting in this study document study by review, study, analyze the primary, secondary and tertiary subject and interview. Based on survey results revealead, that the principles of freedom of expression through the labor unions by the law an regulations set forth in article 6 0f Laws No.9 of 1998 which provides that every citizen shall be obliged to express his opinion freely independence and responsibility in public. Trade unions play a role as a party in the manufacture of collective Labor Agreement (CLA) between employees, as workes representatives in the institutions of cooperation in the settlement of dissputes at all stages of the settlement of workers.
