Abstract

ABSTRACT Haryanto, Role Of Intellecctual Property Registration In The Bran To Legal Protection For Statutory Small And Mediumenterprises ( SME ) Based On Law Number 15 In 2001 About Brand Viewed from its function as a business brand has a very significant role, the main function of a trademark is to enable consumers to characterize a product (goods or services) owned by UKM so it can be difference from other UKM product or other company that similar by competitors. Consumers who are satisfied with a particular product to buy or use the product again in the future. Research conducted by the author using Empirical judicial approach, in this case trademark law as an approach to explain the factors that led to many UKM have not registered the brand, constraints that faced by UKM in the form of trademark registration and protection will be obtained for UKM at Serang that has been registered the brand. The results showed that factors that causes many UKM have not registered the brand among other factors the absence of legal protection of the brand from the view of the communal culture or traditional, economic factors of UKM or entrepreneurs with low-level, awareness factor of the UKM about using copyright and trademark infringement risk, less socialization factors about how important is brand protection of UKM, so that UKM do not know requirements trademark registration and socialization factors of legislation, especially the laws of intellectual property rights of Brand. The obstacles encountered in trademark registration (Regional Offices of the Ministry of Law and Human Rights) are still lack, domicile mileage of UKM with trademark registration office that deals directly with a very distant and consuming much time, absence of a trademark registration incentive program for UKM by local governments, Less coordination in providing trademark registration fee incentive programs to the UKM. While therole of registration of Intellectual Property Rights in the Field of brands to legal protection for UKM, among others is the legal protection is basically a form of recognition of the rights to the brand that is owned by a form of industry that was born because of the ability and the result of a creation. With the UKM brands registration is expected to gain strong legal protection with brand certificate and Registration Number obtained. Keywords: Brand, UKM, protection
