Abstract

GOVERNMENT RESPONSIBILITY FOR EXCESS CAPACITY OF INSTITUTIONS INCLASS IIA CILEGON CORPORATE GOVERNMENT INSTITUTIONS RELATED TO THE ENFORCEMENT OF GOVERNMENT REGULATION OFTHE REPUBLIC OF INDONESIA NUMBER 99 YEAR 2012 CONCERNING REQUIREMENTS FOR IMPLEMENTATION OF CITIZENS RIGHTS IMPLEMENTATION IBNU HASAN 1111150138 ABSTRACT The problem of excess capacity of inmates in Correctional Institutions has become an old problemthat has never been resolved, the total capacity of inmates in Class IIA Cilegon Correctional Institutions has exceeded its proper capacity, so that the fulfillment of the rights of inmates does not run optimally. Based on the background of the problem, the identification of the problem usedin this thesis is how the government's responsibility for the excess capacity of inmates in the Class IIA Cilegon Correctional Institution is related to the enforcement of Government Regulation No. 99 of 2012 concerning the Terms and Procedures for the Implementation of the Rights of Inmates.What are the efforts made in dealing with the excess capacity of the inmates at the Class IIA Cilegon Correctional Institution in relation to the Applicability of Government Regulation No. 99 of 2012 concerning the Terms and Procedures for the Implementation of the Rights of the Prisoners. The theory used is the theory of Human Rights and the theory of correctional. The method used in this research is empirical juridical, research specifications used empirical juridical approach, data sources used were secondary and continued with primary data, with interview data collection techniques, literature study and observation. The findings in this study are that the correctional institution has a responsibility for excess capacity, in this case the Cilegon Class IIAPenitentiary may be subject to sanctions due to the process of fostering the inmates at the CilegonClass IIA Correctional Institution that has not been maximized, but because of the number of inmates in the IIA Prison. Cilegon's number exceeds the proper capacity so that it is not comparable to building facilities and Cilegon officers. The results of the research show that the government isresponsible for the excess capacity that occurs in the Cilegon Class IIA Correctional Institution. Suggestions are that the central government is expected to pay special attention to Cilegon class IIA prisons and to form special laws and regulations governing correctional development. Berdasarkan latar belakang Masalah tersebut, identifiksi masalah yang digunakan dalam skripsi ini adalah Bagaimana Tanggung jawab pemerintah terhadap kelebihan kapasitas warga binaan di LembagaPemasyarakatan Kelas IIA Cilegon Berkaitan Dengan Keberlakuan Peraturan Pemerintah Nomor 99 tahun 2012 Tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyaraktan. Apa upaya yang dilakukan dalam menangani kelebihan kapasitas warga binaan di Lembaga Pemasyarakatan Kelas IIA Cilegon Berkaitan Dengan Keberlakuan Peraturan Pemerintah Nomor99 tahun 2012 Tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyaraktan. Teori yang digunakan yaitu teori Hak Asasi Manusia dan teori pemasyarakatan. Metode yang digunakan dalam penelitian ini yaitu yuridis empiris, Spesifikasi penelitian yang digunakan pendekatan yuridis empiris, sumber data yang digunakan sekunder dan dilanjutkan dengan data primer, dengan teknik pengumpulan data wawancara, studi pustaka dan pengamatan. Temuan dalam penelitian ini yaitu, lembaga pemasyarakatan mempunyai tanggung jawab terhadap kelebihan kapasitas dalam hal ini lembaga pemasyarakatan kelas IIA Cilegon dapat dikenakan sanksi akibat proses pembinaan warga binaan di Lembaga Pemasyarakatan Kelas IIA Cilegon binaan belum maksimal mungkin akan tetapi karena jumlah penghuni warga binaan di Lapas IIA Cilegon jumlahnya melebihi kapasitas yang seharusnya sehingga tidak sebanding dengan fasilitias bangunan dan petugas cilegon. Hasil penelitain menunjukan pemerintah bertanggung jawab terhadap elebihan apasitas yang terjadi di lembaga pemasyarakatan kelas IIA cilegon. Saran diharapkan pemerintah pusat memberikan perhatian khusus terhadap lembaga pemasyarakatan kelas II A Cilegon serta membentuk peraturan perundang�undangan yang khususdan mengatur tentang pembinaan pemasyarakatan.
