Abstract

Customary land rights land conflicts in Indonesia are latent potential conflicts. Not visible but has a big potential to 'explode' and become big. The common pattern of disputes is the vertical pattern between the state (PTPN and Perhutani) and indigenous peoples. But the conflict that was highlighted in this study was the internal conflict of indigenous groups, namely Akur Cigugur. This study analyzes the space production process carried out by Djaka Rumantaka through legal channels in the dispute over ulayat land in Mayasih Block, Cigugur District. The law itself has specifications about the validity of a space. Further the law is a contestation arena from various interests of the parties to the dispute who want to control a space. Djaka Rumantaka through the law was able to force the Akur Cigugur indigenous people to negotiate their customary land which they previously believed to be ancestral heritage. The spatial and political theory presented by Franz von Benda Beckmann, Keebet von Benda Beckmann and Anne Griffths provides an important lens in viewing the law. Beckmann's theory is able to explain this phenomenon because law is one of the ways and tools to construct, organize, and legitimize space and its boundaries.
